Veraset ilamı (mirasçılık belgesi); ölen bir kişinin mirası üzerinde hak sahibi olan kişilerin yani murisin mirasçılarının, hak sahipliğinin ispatını sağlayan resmi evraktır. Çeşitli hukuki işlemlerin tamamlanabilmesi için gerekli olan veraset ilamına, bilhassa tenkis davası ve izale – i şüyu davalarında ihtiyaç duyulur.
Veraset ilamı önceden sadece sulh hukuk mahkemesinden alınabilmekteyken yapılan kanun değişikliğiyle birlikte artık noterlik kanalıyla da mirasçılık belgesi alınabilir. Mirasçılık belgesinin nasıl alındığını kısaca ifade ettikten sonra bu belgenin hukuki niteliğine değinmemiz yararlı olacaktır.
Veraset İlamı (Mirasçılık Belgesi) Nedir?
Veraset ilamı, mirasçılık sıfatını gösterir resmi evraktır. Uygulamada mirasçılık belgesi olarak da bilinen işbu evrak, sulh hukuk mahkemesi ya da noterlik kanalıyla yasal mirasçılara verilir. Peki, söz konusu belge ile neler tespit edilir? Bir murisin;
- Yasal mirasçılarının kim ya da kimler olduğu,
- Mirasçıların miras payları,
Mirasçılık belgesi ile tespit edilir. Bahse konu belge olmadan miras intikal işlemlerinin yapılabilmesi mümkün değildir. Veraset ilamı düzenlenmesinin esas maksadı, tereke üzerinde hak sahibi olan mirasçıların hukuki hallerinin tespitini sağlamaktır. Bu sayede, mirasçıların tereke üzerinde zilyetliği sağlanır veya tasarruf olanağı tanınır.
Veraset İlamı Nasıl Alınır?
Veraset ilamını nasıl alınır? sorusuna kısaca şu şekilde yanıt verebiliriz: veraset ilamı yani mirasçılık belgesi, noterlik kanalı ya da sulh hukuk mahkemesi üzerinden alınır. İşbu belgeyi alabilmek için mirasçıların tamamının başvuruda bulunması şart olmayıp tek bir mirasçının başvurusu kafidir. Fakat mirasçıların istemi olmadan mirasçılık belgesi düzenlenmesi mümkün değildir.
Mirasçılık Belgesi İçin Gerekli Belgeler
Veraset ilamı almak için gereken belgeler şunlardır:
- Nüfus cüzdanı fotokopisi,
- Nüfus kayıt örneği,
- Ölüm belgesi,
- Mirasçılık belgesi istemini içeren dilekçe.
Veraset İlamı Nereden Alınır?
Veraset ilamı; sulh hukuk mahkemesi ve noterlikler olmak üzere iki farklı merciden alınabilir. Fakat belirli durumlarda noterliklerden mirasçılık belgesi alınamaz. Zira Noterlik Kanunu ile noterlerin bu belgeye düzenleme alanı sınırlandırılmıştır. Bu tür bir durumda doğrudan sulh hukuk mahkemesine müracaat etmek icap eder. Peki, söz konusu haller yani doğrudan sulh hukuk mahkemesine başvurulması gereken haller nelerdir?
- Mirasçı ve muris arasındaki soy bağı ilişkisinin noterlik marifetiyle tespit edilememesi,
- Nüfus kayıtlarının yeterince açık olmaması,
- Murisin vasiyetname düzenlemiş olması,
- Başvuru sahibinin ya da mirasçılardan en az birinin yabancı olması,
hallerinde veraset belgesi alabilmek için direkt sulh hukuk mahkemesinde müracaat etmek gerekir.
Kimler Veraset İlamı (Mirasçılık Belgesi) Talep Edebilir?
Veraset ilamı yasal ve atanmış mirasçılarca talep edilebilir. Dolayısıyla gerek yasal mirasçıların gerekse atanmış mirasçıların, sulh hukuk mahkemelerine ya da noterliklere başvurmak suretiyle mirasçılık belgesi isteme hakkı vardır.
Murisin alacaklıları da İcra ve İflas Kanunu m. 94 düzenlemesine istinaden mirasçılık belgesi talep edebilir. Fakat bunun için yani alacaklıların bu belgeyi isteyebilmeleri için mevcutta icra takibi bulunmalı yahut icra müdürlüğünce verilmiş bir yetki olmalıdır.
Kimler Mirasçılık Belgesi Talep Edemez?
- Aşağıda belirtilen kişilerin bu belgeyi talep etme hakkı bulunmaz:
- Reddi mirasta bulunan,
- Mirastan feragat eden,
- Mirastan yoksun olan,
- Ölüme bağlı tasarruflarda açıkça mirastan çıkarılan,
- Mirasın geçmesinden önce müracaat eden art mirasçı ya da yedek mirasçı,
- Boşanmış eş,
- Yüklemeden yararlanan,
- Tereke ile alakası bulunmayan 3. kişiler.
Söz konusu kişiler kural gereği veraset ilamı isteyemezler. Fakat istisnai olarak reddi mirasta bulunan, mirastan çıkarılan, mirastan oksun olan veya mirastan feragat eden mirasçılar da mirasçılık belgesi isteminde bulunabilir.
Veraset İlamının İptali
Veraset ilamının aksi ispat edilebilir. Zira bu belge kesin hüküm teşkil etmemektedir. Bu nedenle, anılan belgenin yanlış olduğu, belgede eksikliklerin bulunduğu ve geçersizliği her zaman ileri sürülebilir. Bu durumda, mirasçıların yerleşim yerindeki asliye hukuk mahkemesinde dava açılabilir. Mirasçılık belgesinin iptaline ilişkin açılacak davan herhangi bir süreye tabi değildir.
Veraset İlamı (Mirasçılık Belgesi) e-Devletten Alınır mı?
Mirasçılık belgesi için e – Devlet Kapısı kullanılamaz. Zira işbu belge sadece sulh hukuk mahkemelerinden yahut noterliklerden alınabilir. Fakat mahkemece düzenlenen evraka, e – Devlet Kapısı üzerinden erişilebilir. Bununu için “Veraset İlamı Sorgulama” bölümünü kullanmak gerekir.
Veraset İlamı Ücreti Ne Kadar?
Veraset ilamı ücreti, ilamın nereden alındığına göre farklılık gösterir. Şayet noterlik kanalı üzerinden mirasçılık belgesi alınacaksa 2023 yılı için 2 kişi ücreti 680,00 TL’dir. Ücret miktarı mirasçı sayısına göre farklılık gösterir. Belgenin sulh hukuk mahkemesi kanalıyla alınması halinde ise 872,20 TL’dir. Sürecin deneyimli bir miras avukatı ile takip edilmesi halinde bir de avukatlık ücreti ödenmesi gerekir.
