Arsa payı kısaca bir arsa üzerinde ortak mülkiyet haklarının bağımsız bölümlere tahsis edilen kısımlarını ifade etmektedir. Özellikle ticari, turizm veya sanayi kazanç yoğunluğunun olduğu şehirlerde toprağın az ve değerli olması nedeniyle aynı arsa üzerinde pek çok malikin müşterek mülkiyet sahibi olduğu yapılanmaların görüldüğü de bilinmekte. Aynı zamanda arsa payı kavramının Anayasanın 35’inci maddesinde yer alan “mülkiyet hakkı” kapsamında da ele alındığını belirtiliyor.
Kanunda Arsa Payı
Arsa payı kavramının Kentsel Dönüşüm Kanunu olarak bilinen 6306 sayılı “Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun” çerçevesinde büyük önem kazandığını ifade edebiliriz. Kanuna göre eski yapının yıkılıp yeniden yapılması sırasında bağımsız bölüm sahibi kişilerin, sahip oldukları arsa payı hisseleri oranında üçte iki çoğunlukla karar verebilme hakları olduğunu da rahatlıkla dile getirebiliriz. Benzer şekilde, 634 sayılı Kat Mülkiyeti Kanununa göre de maliklerin sahip oldukları hak ve yükümlülükleri kullanmalarının da arsa paylarıyla orantılı olduğunu hatırlatma fayda var.
Arsa Payı Nasıl Paylaştırılır ?
Arsa payı belirlenirken yetkili kimselerin, arsa paylarını objektif, hakkaniyete ve yasalara uygun paylaştırması gerekmektedir. Bununla beraber uygulamada proje müelliflerinden ve/veya yapımcı müteahhitlerden bazılarının ticari endişelerle veya konunun uzmanı olmadıkları için arsa payını objektiflikten uzak bir biçimde ve kanunda belirtilen kriterleri dikkate almadan tespit ettiği herkesçe bilinmektedir. Birçok uygulamada arsa paylarının gelişigüzel biçimde arsa alanının ana gayrimenkulde bulunan toplam bağımsız bölümlerin sayısına bölünmek suretiyle, eşit pay verilerek veya bağımsız bölümlerin sadece büyüklükleri yani metrekareleri esas alınarak belirlendiği yanlış uygulamalar da görülmektedir.

Arsa Payları Nasıl Belirlenir ?
Arsa payları belirlenirken kanunun kurduğu sistem, her bir bağımsız bölüme kat irtifakı veya kat mülkiyeti kurulduğu tarihte mevcut şerefiye değerleriyle orantılı bir arsa payı verilmesidir. Yani aynı büyüklükte de olsa deniz gören bir daire ile istinat duvarına bakan aynı bina ve kattaki dairenin değerinin aynı olmayacağı için arsa payı da aynı olmamalıdır. Fakat özellikle eski yapılarda arsa paylarının adil olmayan şekilde dağıtılmış örneklerine rastlanıyor. Bilhassa proje mükellifinin aynı zamanda müteahhit olduğu eski zamanlarda yapılan binalarda bu durum oldukça fazla görülüyor. Örneğin tümü aynı özelliklere sahip dairelerin bulunduğu bir yapıda, aynı arsa payına sahip olması gereken bağımsız bölümlerin farklı arsa paylarına sahip olması şeklinde karşımıza çıkıyor. Bazı durumlarda ise bu malikler arsa payı nedeniyle son 40 senedir komşularına göre daha fazla genel gider de ödemiş olabiliyor. Bu durum genelde hâlihazırda içinde oturulurken fark edilmeyip sorun yaratmıyor. Ancak riskli bölge özelliği olan bölgelerde veya riskli yapı özelliği kazanan binanın yıkılıp tekrar yapılması sırasında, o zamana kadar aynı mülkiyet haklarına sahip olmuş maliklerin yeni yapıda ciddi anlamda hak kayıplarına uğramalarına ya da haksız kazanç elde etmelerine neden oluyor.
