M\u00fclkiyet hakk\u0131 TMK m.683\u2019te \u2018Bir \u015feye malik olan kimse, hukuk d\u00fczeninin s\u0131n\u0131rlar\u0131 i\u00e7inde, o \u015fey \u00fczerinde diledi\u011fi gibi kullanma, yararlanma ve tasarrufta bulunma yetkisine sahiptir.\u2019 \u015feklinde d\u00fczenlenmi\u015ftir. Bu madde h\u00fckm\u00fcnden de anlayaca\u011f\u0131m\u0131z gibi m\u00fclkiyet hakk\u0131 hak sahibine en geni\u015f yetkileri veren bir ayni hakt\u0131r. M\u00fclkiyet hakk\u0131n\u0131n payl\u0131 m\u00fclkiyet ve elbirli\u011fi

Payl\u0131 M\u00fclkiyet Nedir ?<\/h2>\r\n\r\n\r\n\r\n

Payl\u0131 m\u00fclkiyet maddi olarak b\u00f6l\u00fcnemeyen bir mal\u0131n \u00fczerinde birden \u00e7ok ki\u015finin malik olmas\u0131d\u0131r. Yani tek bir m\u00fclkiyet hakk\u0131 vard\u0131r ancak bu hak tek bir ki\u015fiye de\u011fil birden \u00e7ok ki\u015fiye aittir. Pay sahiplerinin her birine payda\u015f denir ve aksi kararla\u015ft\u0131r\u0131lmam\u0131\u015fsa her bir payda\u015f e\u015fit paya sahiptir. Payda\u015flar\u0131n her biri m\u00fclkiyetin bir k\u0131sm\u0131nda hak sahibidir fakat bu paylar somut veya maddi de\u011fil m\u00fclkiyet hakk\u0131ndan do\u011fan baz\u0131 yetki ve \u00f6devler \u015feklindedir. Payda\u015flar\u0131n her biri, di\u011ferlerinin haklar\u0131n\u0131 \u00e7i\u011fnemedi\u011fi s\u00fcrece payl\u0131 m\u00fclkiyet konusu mal\u0131 kullanabilir ve ondan yararlanabilir.<\/p>\r\n\r\n\r\n\r\n

Her payda\u015f kendi pay\u0131 oran\u0131nda hak ve y\u00fck\u00fcml\u00fcl\u00fcklere sahiptir. Yine her payda\u015f di\u011fer payda\u015flar\u0131n r\u0131zas\u0131 veya onay\u0131 olmaks\u0131z\u0131n kendi pay\u0131n\u0131 devredebilir, rehnedebilir veya alacakl\u0131lar\u0131 taraf\u0131ndan pay\u0131 haczettirilebilir. Di\u011fer payda\u015flar\u0131n haklar\u0131n\u0131 ihlal etmeyecek \u015fekilde s\u0131n\u0131rl\u0131 ayni haklar kurulabilir ve her payda\u015f kendi pay\u0131n\u0131 satabilir bunula ilgili di\u011fer payda\u015flar\u0131n \u00f6nal\u0131m hakk\u0131 sakl\u0131d\u0131r. Payl\u0131 m\u00fclkiyet kanundan do\u011fabilece\u011fi gibi bir hukuki i\u015flem ya da s\u00f6zle\u015fmeden de do\u011fabilir.<\/p>\r\n\r\n\r\n\r\n

Elbirli\u011fi M\u00fclkiyeti nedir ?<\/h2>\r\n\r\n\r\n\r\n

Elbirli\u011fi m\u00fclkiyeti TMK m.701\u2019de \u2018\u2019 Elbirli\u011fi m\u00fclkiyetinde ortaklar\u0131n belirlenmi\u015f paylar\u0131 olmay\u0131p her birinin hakk\u0131, ortakl\u0131\u011fa giren mallar\u0131n tamam\u0131na yayg\u0131nd\u0131r.\u2019\u2019 \u015feklinde tan\u0131mlanm\u0131\u015ft\u0131r. Bu kanun h\u00fckm\u00fcnden yola \u00e7\u0131kacak olursak elbirli\u011fi m\u00fclkiyeti aralar\u0131nda ortakl\u0131k ili\u015fkisi bulunan ki\u015filerin birlikte malik olmas\u0131d\u0131r. Payl\u0131 m\u00fclkiyetten farkl\u0131 olarak elbirli\u011fi m\u00fclkiyetinde her bir ortak mal\u0131n tamam\u0131na maliktir. Yine tek bir m\u00fclkiyet s\u00f6z konusudur fakat ortaklar\u0131n paylar\u0131 net de\u011fildir. Ortaklar mal\u0131 satamaz ve rehnemez, haciz ise ortakl\u0131k tasfiye edildikten sonra orta\u011fa d\u00fc\u015fecek paya konulabilir. Aksine h\u00fck\u00fcm olmad\u0131k\u00e7a ortaklar mal \u00fczerinde her t\u00fcrl\u00fc i\u015fi ancak oy birli\u011fiyle yapabilir, tek ba\u015flar\u0131na i\u015flem yapamazlar. Elbirli\u011fi m\u00fclkiyeti yaln\u0131zca kanunda say\u0131lan durumlarda veya s\u00f6zle\u015fme tiplerinde kurulabilir. Elbirli\u011fi m\u00fclkiyetin sona ermesi mal\u0131n devri, toplulu\u011fun sonra ermesi veya payl\u0131 m\u00fclkiyete ge\u00e7ilmesi hallerinde olur.<\/p>\r\n\r\n\r\n\r\n

Elbirli\u011fi m\u00fclkiyette ortaklardan her birinin payl\u0131 m\u00fclkiyete ge\u00e7me talebinde bulunma hakk\u0131 vard\u0131r. 3402 say\u0131l\u0131 Kadastro Kanunu ek madde 3\u2019te \u2018\u2019Bir miras\u00e7\u0131, miras ortakl\u0131\u011f\u0131ndan do\u011fan elbirli\u011fi m\u00fclkiyetinin payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi isteminde bulundu\u011fu takdirde tapu sicil m\u00fcd\u00fcr\u00fc, di\u011fer miras\u00e7\u0131lara \u00e7a\u011fr\u0131da bulunarak belirleyece\u011fi s\u00fcre i\u00e7inde varsa itirazlar\u0131n\u0131 bildirmeye davet eder.<\/p>\r\n\r\n\r\n\r\n

Tebligat masraflar\u0131 ilgilisince kar\u015f\u0131lan\u0131r. Elbirli\u011fi m\u00fclkiyetinin devam\u0131na y\u00f6nelik bir itiraz ileri s\u00fcr\u00fclmedi\u011fi veya miras\u00e7\u0131lardan herhangi biri belirlenen s\u00fcre i\u00e7inde payla\u015fma davas\u0131 a\u00e7mad\u0131\u011f\u0131 takdirde, istem konusu ta\u015f\u0131nmaz mal \u00fczerindeki elbirli\u011fi m\u00fclkiyeti payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fclerek, hissedarl\u0131k esaslar\u0131na g\u00f6re miras\u00e7\u0131lar ad\u0131na tapu k\u00fct\u00fc\u011f\u00fcne tescil edilir.\u2019\u2019 denilerek her orta\u011f\u0131n tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u015fvuruda bulunarak bu hakk\u0131n\u0131 kullanabilece\u011fini belirtmi\u015ftir. Burada bir davadan de\u011fil \u00e7eki\u015fmesiz yarg\u0131 i\u015finden bahsedilmektedir. Ortaklardan birinin\/ birka\u00e7\u0131n\u0131n tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne bu y\u00f6nde bir talepte bulunmas\u0131 halinde tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fc di\u011fer ortaklara tebligat g\u00f6ndererek belirleyece\u011fi s\u00fcre i\u00e7inde varsa itirazlar\u0131n\u0131 bildirmelerini ister. Tebligat masraflar\u0131 ba\u015fvuruda bulunan ortak\/ortaklar taraf\u0131ndan \u00f6denmedi\u011fi s\u00fcrece i\u015flemlere ba\u015flan\u0131lmaz. E\u011fer belirlenen s\u00fcre i\u00e7inde itiraz edilmez ve payla\u015fma davas\u0131 da a\u00e7\u0131lmaz ise paylar tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce tapuya tescil edilmek suretiyle ortaklar\u0131n paylar\u0131 oran\u0131nda payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fcl\u00fcr. \u0130tiraz edilmesi veya payla\u015fma davas\u0131 a\u00e7\u0131lmas\u0131 durumunda payl\u0131 m\u00fclkiyete ge\u00e7irme i\u015flemi yap\u0131lamaz.<\/p>\r\n\r\n\r\n\r\n

Yine benzer bir d\u00fczenleme de TMK m.644<\/strong>\u2019te \u2018\u2019 Bir miras\u00e7\u0131, terekeye dahil mallar\u0131n tamam\u0131 veya bir k\u0131sm\u0131 \u00fczerindeki elbirli\u011fi m\u00fclkiyetinin payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi isteminde bulundu\u011fu takdirde sulh hakimi, di\u011fer miras\u00e7\u0131lara \u00e7a\u011fr\u0131da bulunarak belirleyece\u011fi s\u00fcre i\u00e7inde varsa itirazlar\u0131n\u0131 bildirmeye davet eder. Elbirli\u011fi m\u00fclkiyetinin devam\u0131n\u0131 hakl\u0131 k\u0131lacak bir itiraz ileri s\u00fcr\u00fclmedi\u011fi veya miras\u00e7\u0131lardan biri belirlenen s\u00fcre i\u00e7inde payla\u015fma davas\u0131 a\u00e7mad\u0131\u011f\u0131 takdirde, istem konusu mal \u00fczerindeki elbirli\u011fi m\u00fclkiyetinin payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesine karar verilir. Terekeye dahil di\u011fer haklar\u0131n ve alacaklar\u0131n paylar oran\u0131nda b\u00f6l\u00fcnmesi hususunda da yukar\u0131daki h\u00fck\u00fcmler uygulan\u0131r.\u2019\u2019 \u015feklinde d\u00fczenlenmi\u015ftir. Bu h\u00fck\u00fcmden de anla\u015f\u0131laca\u011f\u0131 \u00fczere ortaklardan her biri sulh hakiminden mal\u0131n tamam\u0131n\u0131n veya bir k\u0131sm\u0131n\u0131 payl\u0131 m\u00fclkiyete ge\u00e7irilmesi isteminde bulunabilir.. Burada g\u00f6revli mahkeme HMK M.4\/1-b\u2019e g\u00f6re sulh hukuk mahkemesidir. Yetkili mahkeme ise HMK m.12\/1\u2019e g\u00f6re dava konusu ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer sulh hukuk mahkemesidir. Sulh hukuk hakimi di\u011fer ortaklara davetiye g\u00f6ndererek elbirli\u011fi m\u00fclkiyetinin devam\u0131n\u0131 hakl\u0131 k\u0131lacak itirazlar\u0131 varsa bunlar\u0131 bildirmelerini ister. G\u00f6nderilecek davetiyede \u2018\u2019elbirli\u011fi m\u00fclkiyetinin devam\u0131n\u0131n hakl\u0131 k\u0131lacak bir itiraz ileri s\u00fcr\u00fclmedi\u011fi veya miras\u00e7\u0131lardan biri belirlenen s\u00fcre i\u00e7inde payla\u015fma davas\u0131 a\u00e7mad\u0131\u011f\u0131 taktirde, istem konusu mal \u00fczerindeki elbirli\u011fi m\u00fclkiyetinin payl\u0131 m\u00fclkiyete d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesine karar verilece\u011fi\u2019\u2019 ihtar\u0131n\u0131n bulunmas\u0131 zorunludur aksi halde bozma sebebidir. E\u011fer belirlenen s\u00fcre i\u00e7erisinde bir itirazda bulunulmad\u0131\u011f\u0131 veya payla\u015fma davas\u0131 da a\u00e7\u0131lmad\u0131\u011f\u0131 yada m\u00fclkiyeti etkileyen herhangi bir dava bulunmad\u0131\u011f\u0131 vb. taktirde sulh hakimi elbirli\u011fi m\u00fclkiyetinin payl\u0131 m\u00fclkiyete \u00e7evrilmesine karar verir. Payl\u0131 m\u00fclkiyete \u00e7evrildikten sonra payda\u015flar isterlerse ortakl\u0131\u011f\u0131n giderilmesi davas\u0131 a\u00e7arak paylar\u0131 \u00fczerinde tek ba\u015flar\u0131na malik olabilirler.<\/p>\r\n
