Bu t\u00fcr bir yol izlenece\u011fi zaman \u00f6zel m\u00fclkiyete konu ta\u015f\u0131nmazlarda malikin r\u0131zas\u0131 d\u0131\u015f\u0131nda ta\u015f\u0131nmaza idare taraf\u0131ndan el konulmaktad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u00d6zel m\u00fclkiyete konu ta\u015f\u0131nmazlar\u0131n tamam\u0131 veya bir k\u0131sm\u0131 bu yolla kamula\u015ft\u0131r\u0131labilir. Ger\u00e7ek ve t\u00fczel \u00f6zel hukuk ki\u015filerine ait olan ta\u015f\u0131nmazlarda ger\u00e7ekle\u015ftirilebilen kamula\u015ft\u0131rmada bedel idare taraf\u0131ndan pe\u015fin olarak \u00f6denmelidir.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rma (\u0130stimlak) Nedir?<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamu yarar\u0131 sebep g\u00f6sterilerek \u00f6zel m\u00fclkiyete konu olan mallarda sahipli\u011fe ki\u015finin r\u0131zas\u0131 d\u0131\u015f\u0131nda son verilmesi devletin yapabilece\u011fi \u00e7al\u0131\u015fmalardan biridir. \u0130dare bu i\u015flemleri yaparken \u00f6zel m\u00fclkiyetin bedelini \u00f6der. Kamula\u015ft\u0131rma ko\u015fullar\u0131 ger\u00e7ekle\u015fti\u011finde bu i\u015flem yap\u0131labilir. Kamula\u015ft\u0131rma \u015fartlar\u0131 a\u015fa\u011f\u0131daki bi\u00e7imde s\u0131ralanabilir:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Kamula\u015ft\u0131rmay\u0131 yetkili idare yapabilir,<\/li>\n<li>Kamu yarar\u0131 g\u00f6zetilmesi zorunludur,<\/li>\n<li>Kamula\u015ft\u0131rman\u0131n konusu \u00f6zel m\u00fclkiyete konu ta\u015f\u0131nmazlar\u0131 ilgilendirmelidir,<\/li>\n<li>\u00d6zel m\u00fclkiyete konu olan kamula\u015ft\u0131rmada mal\u0131n bedeli pe\u015fin \u00f6denir,<\/li>\n<li>Kamula\u015ft\u0131rma yasadaki esaslar g\u00f6zetilerek yap\u0131lmal\u0131d\u0131r.<\/li>\n<\/ul>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rma (\u0130stimlak) Bedeli<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rma i\u015flemini yapan idare ko\u015fullar\u0131n varl\u0131\u011f\u0131 durumunda bu \u00e7al\u0131\u015fmay\u0131 tamamlayabilir. Kamula\u015ft\u0131rma bedeli \u00f6denirken ta\u015f\u0131nmaz\u0131n tamam\u0131 ya da bir k\u0131sm\u0131 kamula\u015ft\u0131r\u0131lacaksa buna g\u00f6re bedel belirlenir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rma s\u0131ras\u0131nda tar\u0131m reformu uygulanacaksa, b\u00fcy\u00fck enerji ve sulama projeleri ger\u00e7ekle\u015ftirilece\u011fi zaman veya isk\u00e2n projeleri s\u00f6z konusu ise \u00f6deme \u015fekli kanunda yer al\u0131r. K\u0131y\u0131lar\u0131n korunmas\u0131, yeni ormanlar\u0131n yeti\u015ftirilmesi veya turizm amac\u0131 has\u0131l oldu\u011funda kamula\u015ft\u0131r\u0131lacak topraklar i\u00e7in bedel tespiti kanuna g\u00f6re yap\u0131lmaktad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Bu t\u00fcr alanlarda kamula\u015ft\u0131rma bedeli taksitle \u00f6denebilir. Taksit s\u00fcresi 5 y\u0131l\u0131 a\u015famayan bu t\u00fcr kamula\u015ft\u0131rma \u00e7al\u0131\u015fmalar\u0131nda taksitler e\u015fit olarak hesaplan\u0131r. K\u00fc\u00e7\u00fck \u00e7ift\u00e7iye ait olan ve kamula\u015ft\u0131r\u0131lan topra\u011f\u0131 do\u011frudan do\u011fruya i\u015fleten \u00e7ift\u00e7ilerin \u00f6demesi ise her halde pe\u015fin olarak yap\u0131l\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Taksitlendirme yap\u0131laca\u011f\u0131 zaman veya herhangi bir nedenle \u00f6denmeyen kamula\u015ft\u0131rma bedeli s\u00f6z konusu oldu\u011funda ise kamu alacaklar\u0131na y\u00f6nelik \u00f6ng\u00f6r\u00fclm\u00fc\u015f olan en y\u00fcksek faiz oranlar\u0131 \u00fczerinden hesaplama yap\u0131lmaktad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rmaya ili\u015fkin merak konusu hususlar\u0131 incelemeden \u00f6nce belirtmekte fayda var: bu s\u00fcrecin takibi, gerekli hukuki i\u015flemlerin icras\u0131 ve s\u00fcrecin \u00f6zenle takibi i\u00e7in yetkin bir <a href=\"https:\/\/esen.av.tr\/en\/portfolio\/gayrimenkul-hukuku\/\"><strong>gayrimenkul avukat\u0131<\/strong><\/a>ndan yard\u0131m almak en sa\u011fl\u0131kl\u0131 yakla\u015f\u0131m olacakt\u0131r.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rma (\u0130stimlak) S\u00fcreci<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130dari ve yarg\u0131sal a\u015famalara konu olan kamula\u015ft\u0131rmada idari i\u015flemleri ilgili idare yapar. Yarg\u0131sal s\u00fcre\u00e7lerde ise yetkili ve g\u00f6revli mahkemeler devreye girer. Kamula\u015ft\u0131rma s\u00fcreci s\u00f6z konusu oldu\u011funda ilk a\u015fama idari a\u015famad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Kanunla yetkili k\u0131l\u0131nan ilgili idare kamula\u015ft\u0131rma i\u015flemini ba\u015flat\u0131rken usul ve esaslara uymak zorundad\u0131r. Bu a\u015fama idarenin \u00e7al\u0131\u015fman\u0131n usul ve esaslara uygun \u015fekilde yap\u0131lmas\u0131na y\u00f6nelik haz\u0131rl\u0131k s\u00fcrecini kapsar.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Haz\u0131rl\u0131k s\u00fcrecinde kamula\u015ft\u0131rma yap\u0131lacak yerde alan ara\u015ft\u0131rmas\u0131 yap\u0131l\u0131r ve ta\u015f\u0131nmaz\u0131n bedeli tespit edilir. \u0130dare bu a\u015famada rasyonel kararlar almakla y\u00fck\u00fcml\u00fc olur. Ta\u015f\u0131nmaza ait ger\u00e7ek bedelin tespiti y\u00f6n\u00fcnde \u00e7al\u0131\u015fma yapmas\u0131 gereken idare ta\u015f\u0131nmaz\u0131n tahmini bedeline b\u00fct\u00e7ede yer vermelidir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Kamu yarar\u0131 karar\u0131 al\u0131naca\u011f\u0131 zaman da idare \u015fartlara uygun hareket etmekle y\u00fck\u00fcml\u00fc olur. Kamu yarar\u0131 ki\u015fisel yararlar\u0131n \u00fczerinde olmak zorundad\u0131r. Kamu yarar\u0131 karar\u0131n\u0131 alan yetkili ki\u015filer <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=2942&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">kanun<\/a>da s\u0131n\u0131rl\u0131 say\u0131da belirtilir. Kamu yarar\u0131 karar\u0131n\u0131 vermeye yetkili olan merciler:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Kamu idarelerinin yan\u0131 s\u0131ra kamu t\u00fczelki\u015fileri,<\/li>\n<li>\u0130lgili bakanl\u0131k,<\/li>\n<li>K\u00f6y ihtiyar heyeti,<\/li>\n<li>Belediye enc\u00fcmeni,<\/li>\n<li>\u0130l daim\u00ee enc\u00fcmeni,<\/li>\n<li>\u0130l idare kurulu,<\/li>\n<li>Y\u00fcksek\u00f6\u011fretim kurulu,<\/li>\n<li>\u0130l\u00e7e idare kurulu,<\/li>\n<li>Cumhurba\u015fkan\u0131.<\/li>\n<\/ul>\n<p style=\"font-weight: 400; text-align: justify;\">Kamu yarar\u0131 karar\u0131n\u0131n al\u0131nmas\u0131 tek ba\u015f\u0131na yeterli olmazken bu karar\u0131n ayr\u0131ca yetkili birimlerce de onaylanmas\u0131 gerekir. Bu t\u00fcr bir durumda ise onay vermeye yetkili merciler devreye girmektedir.<\/p>\n<ul style=\"text-align: justify;\">\n<li>K\u00f6y ihtiyar heyeti-belediye enc\u00fcmeni kamula\u015ft\u0131rma kararlar\u0131 il\u00e7ede kaymakam ilde vali onay\u0131ndan ge\u00e7er,<\/li>\n<li>\u0130l\u00e7e idare kurulu, il daim\u00ee enc\u00fcmeni, il idare kurulu kamula\u015ft\u0131rma kararlar\u0131 vali onay\u0131 ile ge\u00e7erli olur,<\/li>\n<li>\u00dcniversite y\u00f6netim kurulu kararlar\u0131 rekt\u00f6r onay\u0131na g\u00f6re verilir,<\/li>\n<li>Y\u00fcksek\u00f6\u011fretim kurullar\u0131n\u0131n alm\u0131\u015f oldu\u011fu kamula\u015ft\u0131rma kararlar\u0131nda kurul ba\u015fkan\u0131n\u0131n onay\u0131 gereklidir,<\/li>\n<li>TRT taraf\u0131ndan al\u0131nacak kamula\u015ft\u0131rma karar\u0131nda genel m\u00fcd\u00fcr onay\u0131 gerekir,<\/li>\n<li>Kamu kurumlar\u0131n\u0131n y\u00f6netim kurulu kararlar\u0131 ile idare meclislerinin kararlar\u0131 denetime tabi olduklar\u0131 bakanl\u0131k\u00e7a onaylan\u0131r,<\/li>\n<li>\u00d6zel hukuk t\u00fczel ki\u015fileri ve ger\u00e7ek ki\u015filere y\u00f6nelik verilen kamula\u015ft\u0131rma karar\u0131 k\u00f6y, \u00f6zel idare ya da belediye taraf\u0131ndan al\u0131n\u0131rsa vali onay\u0131ndan ge\u00e7er,<\/li>\n<li>Bakanl\u0131k ya da Cumhurba\u015fkan\u0131 taraf\u0131ndan verilen kararlar\u0131n ayr\u0131ca onaya ihtiyac\u0131 olmaz.<\/li>\n<\/ul>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130lgili idare kamula\u015ft\u0131rma s\u00fcrecinde ta\u015f\u0131nmaz\u0131n tapu kayd\u0131na y\u00f6nelik olarak kamula\u015ft\u0131rma \u015ferhi konulaca\u011f\u0131 zaman bildirimde bulunur. Bildirim tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne ilgili idare taraf\u0131ndan yap\u0131l\u0131r. Tebligat\u0131n g\u00f6nderilmesi usule uygun olarak yap\u0131ld\u0131\u011f\u0131nda ge\u00e7erli olur.<\/p>\n<h2 style=\"text-align: center;\">Ta\u015f\u0131nmaz\u0131n Tapusu Yoksa Kamula\u015ft\u0131rma (\u0130stimlak) \u0130\u015flemi Nas\u0131l Yap\u0131l\u0131r?<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Ta\u015f\u0131nmaz\u0131n tapusu yoksa kamula\u015ft\u0131rma (istimlak) i\u015flemi i\u00e7in kanuna g\u00f6re hareket edilir. Kamula\u015ft\u0131rma Kanunu uyar\u0131nca bu t\u00fcr ta\u015f\u0131nmazlara y\u00f6nelik ara\u015ft\u0131rma yap\u0131l\u0131r. Kamula\u015ft\u0131r\u0131lacak ta\u015f\u0131nmaz\u0131n kamuya ait olup olmad\u0131\u011f\u0131 belirlenir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Bilirki\u015fi heyeti arac\u0131l\u0131\u011f\u0131 ile ta\u015f\u0131nmaza ait teknik bilgiler, ta\u015f\u0131nmaz\u0131n kime ait oldu\u011fu, ta\u015f\u0131nmaz\u0131 kimin kulland\u0131\u011f\u0131, imar ve ihya yolu ile elde edilen ta\u015f\u0131nmazlarda i\u015flenme durumu incelenir. Bu incelemenin ard\u0131ndan da kamula\u015ft\u0131rmay\u0131 yapmaya yetkili olan ilgili idare tespit edilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Bu i\u015flemlerin tamamlanmas\u0131 ile kamula\u015ft\u0131rma yap\u0131lacak ta\u015f\u0131nmaz\u0131n de\u011fer tespitine ge\u00e7ilir. K\u0131ymet takdiri olarak a\u00e7\u0131klanan bu a\u015famada K\u0131ymet Takdiri Komisyonunun \u00e7al\u0131\u015fmas\u0131na gerek duyulur.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">K\u0131ymet Takdiri Komisyonu ilgili idarede \u00e7al\u0131\u015fan en az \u00fc\u00e7 ki\u015filik bir ekiptir. Bu ekibin kimlerden olu\u015faca\u011f\u0131 kanunda a\u00e7\u0131k\u00e7a belirtilmemekle birlikte konuya h\u00e2kim ki\u015filerden se\u00e7ilmesi uygun olur. K\u0131ymet Takdiri Komisyonunun \u00e7al\u0131\u015fmalar\u0131n\u0131 tamamlamas\u0131n\u0131n ard\u0131ndan da Uzla\u015fma Komisyonu devreye girer.<\/p>\n<h2 style=\"text-align: center;\">Sat\u0131n Alma A\u015famas\u0131-Uzla\u015fmaya Davet ve Pazarl\u0131k S\u00fcreci<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Tapuda kay\u0131tl\u0131 bulunan ta\u015f\u0131nmazlarda sat\u0131n alma usullerine uygun hareket edilmek zorundad\u0131r. Sat\u0131n alma i\u015flemleri yap\u0131l\u0131rken muhataplar\u0131n anla\u015fmaya yana\u015fmamas\u0131 yarg\u0131 yoluna ba\u015fvurmay\u0131 gerekli k\u0131lar.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Sat\u0131n alma i\u015flemleri usule ayk\u0131r\u0131 \u015fekilde yap\u0131l\u0131rsa kamula\u015ft\u0131rma i\u015flemi sakatlan\u0131r. K\u0131ymet Takdiri Komisyonunun yapt\u0131\u011f\u0131 \u00e7al\u0131\u015fman\u0131n ard\u0131ndan muhataplara yap\u0131lan bildirim taahh\u00fctl\u00fc olarak ve yaz\u0131l\u0131 bi\u00e7imde ger\u00e7ekle\u015fir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Bu bildirimde sat\u0131n alman\u0131n ne \u015fekilde ger\u00e7ekle\u015fece\u011fi, \u00f6deme y\u00f6ntemi a\u00e7\u0131klan\u0131r. Bildirim tebli\u011f edildikten sonraki 15 g\u00fcn i\u00e7inde ta\u015f\u0131nmaz\u0131n maliki ya da kanuni temsilcisi ilgili idareye ba\u015fvuru yapar. Bu ba\u015fvuru s\u00fcrecinde anla\u015fma yoluna gidilmeye \u00e7al\u0131\u015f\u0131l\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Taraflar aras\u0131nda y\u00fcr\u00fct\u00fclen g\u00f6r\u00fc\u015fmelerde anla\u015fma sa\u011flanamamas\u0131 durumunda veya anla\u015fma sa\u011flansa bile sonraki y\u00fck\u00fcml\u00fcl\u00fcklerin yerine getirilmemesi halinde anla\u015fmazl\u0131k tutana\u011f\u0131 d\u00fczenlenir. Bu s\u00fcre\u00e7 yarg\u0131sal a\u015famaya ge\u00e7ildi\u011fini g\u00f6stermektedir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Taraflar\u0131n anla\u015fma sa\u011flamas\u0131 durumunda ise anla\u015fma tutana\u011f\u0131 d\u00fczenlenerek \u00e7al\u0131\u015fmalara devam edilir. \u0130darenin anla\u015fma tutana\u011f\u0131 d\u00fczenlendikten sonra \u00fczerinde anla\u015f\u0131lan bedeli 45 g\u00fcn i\u00e7inde haz\u0131rlamas\u0131 gerekir. Ard\u0131ndan da tapuda terkin ve tescil i\u015flemleri yap\u0131l\u0131r. Bu s\u00fcre\u00e7 tamamland\u0131ktan sonra ve ta\u015f\u0131nmaz\u0131n bedeli ilgili idarece muhatab\u0131na \u00f6dendi\u011finde yap\u0131lan kamula\u015ft\u0131rma i\u015flemi ve bedele y\u00f6nelik itiraz davas\u0131 a\u00e7ma hakk\u0131 ortadan kalkar.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rma (\u0130stimlak) \u0130\u015flemlerinde Yarg\u0131sal A\u015fama<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rma i\u015flemleri ile ilgili olarak a\u00e7\u0131labilen davalar; maddi d\u00fczeltme davalar\u0131, bedel tespit davalar\u0131, idare ad\u0131na tescil davalar\u0131 ve iptal davalar\u0131 olabilmektedir. Adli ve idari yarg\u0131 s\u00fcreci kamula\u015ft\u0131rma i\u015flemlerine y\u00f6nelik olarak kar\u015f\u0131la\u015f\u0131lan durumlard\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Adli yarg\u0131y\u0131 ilgilendiren uyu\u015fmazl\u0131klarda ilgili idarenin a\u00e7aca\u011f\u0131 dava ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer Asliye Hukuk Mahkemesi\u2019nde olur. Bu davalar ilgili idare ad\u0131na de\u011fer tespiti ve tescil davalar\u0131 olabilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Dava s\u00fcreci ba\u015flad\u0131\u011f\u0131nda muhataba bildirim yap\u0131l\u0131r. Mahkemenin tebligat\u0131n\u0131n ard\u0131ndan idari yarg\u0131 davas\u0131 a\u00e7\u0131lm\u0131\u015f olur. Bu s\u00fcre\u00e7te y\u00fcr\u00fctmenin durdurulmas\u0131 talebi ortaya \u00e7\u0131kabilir. \u0130ptal davas\u0131 \u0130dare Mahkemesi\u2019nde g\u00f6r\u00fcl\u00fcrken bedel tespit davas\u0131 da Asliye Hukuk Mahkemesi\u2019nde g\u00f6r\u00fcl\u00fcr.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rma (\u0130stimlak) Bedelinin Tespiti ve Ta\u015f\u0131nmaz\u0131n Tescili Davas\u0131<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rma (istimlak)bedelinin tespiti ve ta\u015f\u0131nmaz\u0131n tescili davas\u0131 ilgili idarenin usule uygun olarak sat\u0131n alma i\u015flemini ger\u00e7ekle\u015ftirmek isteyip sonu\u00e7 alamad\u0131\u011f\u0131 durumlarda a\u00e7\u0131l\u0131r. Bu durumda kamula\u015ft\u0131rma i\u015fleminin yap\u0131labilmesi i\u00e7in adli yarg\u0131da dava a\u00e7\u0131l\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer Asliye Hukuk Mahkemesi\u2019ne a\u00e7\u0131lacak olan bu dava s\u0131ras\u0131nda idare mahkemeye toplad\u0131\u011f\u0131 bilgi ve belgeleri bir dilek\u00e7eye eklemek sureti ile g\u00f6nderir. \u0130lgili idare bu y\u00f6ntemle mahkemeden kamula\u015ft\u0131rma i\u015flemine y\u00f6nelik ta\u015f\u0131nmaz\u0131n tapuya tescilini talep eder. Dava a\u00e7\u0131ld\u0131\u011f\u0131nda basit yarg\u0131lama usul\u00fcne g\u00f6re hareket edilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Mahkeme belirledi\u011fi duru\u015fma g\u00fcn\u00fcn\u00fc ilgili idarenin ba\u015fvurusunun ard\u0131ndan en az 30 g\u00fcnl\u00fck s\u00fcre i\u00e7inde belirler ve ilgililere tebli\u011f eder. Bu tebligatta \u00e7e\u015fitli bilgilere yer verilir. Ta\u015f\u0131nmaza fiilen bedelsiz olarak idarenin el koymas\u0131 kamula\u015ft\u0131rmas\u0131z el atmad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130lgili idare \u00f6zel m\u00fclkiyete konu olan ta\u015f\u0131nmaza el koyarken bedel \u00f6demez. M\u00fclkiyet hakk\u0131na m\u00fcdahale olan bu durum fiili ve hukuki el atma bi\u00e7iminde ger\u00e7ekle\u015febilir.
