Kamula\u015ft\u0131rmas\u0131z el atma neticesinde m\u00fclkiyet hakk\u0131na m\u00fcdahale edilir. Kamu idaresi kamula\u015ft\u0131rmas\u0131z el atma i\u015flemini iki bi\u00e7imde ger\u00e7ekle\u015ftirebilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Fiili ve hukuki el atma \u015feklinde ger\u00e7ekle\u015febilen kamula\u015ft\u0131rmas\u0131z el atmada idare m\u00fclkiyet hakk\u0131n\u0131 eylem ve i\u015flemleri ile s\u0131n\u0131rland\u0131rmaktad\u0131r. Kamu idaresinin bu davran\u0131\u015f\u0131 ile m\u00fclkiyet hakk\u0131na m\u00fcdahalesi s\u00f6z konusu olur.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rmas\u0131z Fiili El Atma<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rmas\u0131z fiili el atma yap\u0131ld\u0131\u011f\u0131nda idare \u00f6zel m\u00fclkiyete konu olan ta\u015f\u0131nmaz\u0131 kamula\u015ft\u0131rma usullerine uymamak sureti ile zilyetli\u011fine ge\u00e7irmektedir. \u0130darenin zilyetli\u011fine ge\u00e7irdi\u011fi ta\u015f\u0131nmaza hi\u00e7bir bedel \u00f6demedi\u011fi g\u00f6r\u00fcl\u00fcrken kamula\u015ft\u0131rma usullerine de uyulmamaktad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130dare sahibine hi\u00e7bir bedel \u00f6dememek sureti ile ta\u015f\u0131nmaz\u0131 zilyetli\u011fine ge\u00e7irdi\u011finde ta\u015f\u0131nmaz \u00fczerinde tesis in\u015fa ederse bu durum fiili el atmaya \u00f6rnek te\u015fkil eder.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rmas\u0131z Hukuki El Atma<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130dare ta\u015f\u0131nmaza hukuken el koydu\u011funda kamula\u015ft\u0131rmas\u0131z hukuki el atmadan s\u00f6z edilebilir. Kamusal ihtiya\u00e7lar s\u00f6z konusu oldu\u011funda ve kamu yarar\u0131 gerek\u00e7e g\u00f6sterilerek kamula\u015ft\u0131rmas\u0131z hukuki el atma idarenin ba\u015fvurabilece\u011fi y\u00f6ntemlerden biridir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130mar plan\u0131n\u0131n hukuken uygulamaya ge\u00e7irilmedi\u011fi durumlarda ya da fiilen kamula\u015ft\u0131rma yap\u0131lmad\u0131\u011f\u0131nda \u00f6zel m\u00fclkiyete konu olan ta\u015f\u0131nmazla ilgili kullan\u0131m hukuken engellenebilir. Bu durumda malikin \u00f6zel m\u00fclkiyetindeki ta\u015f\u0131nmaza fiziki olarak hi\u00e7bir m\u00fcdahale olmamakla birlikte hukuki yollara ba\u015fvurulur.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Anayasa\u2019da herkesin m\u00fclkiyet hakk\u0131 g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Ki\u015fi maliki oldu\u011fu ta\u015f\u0131nmaz \u00fczerinde tasarrufta bulunma, yararlanma ve kullanma hakk\u0131na sahiptir. Anayasa\u2019ya g\u00f6re g\u00fcvence alt\u0131na al\u0131nan bu hak kamu yarar\u0131 s\u00f6z konusu ise s\u0131n\u0131rland\u0131r\u0131labilmektedir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130darenin kamu yarar\u0131 s\u00f6z konusu olmas\u0131 durumunda ki\u015finin m\u00fclkiyet hakk\u0131n\u0131 s\u0131n\u0131rland\u0131rabilmesi bu gerek\u00e7eye dayand\u0131r\u0131l\u0131r. Bu durumda da idare ta\u015f\u0131nmaz \u00fczerinde ki\u015finin m\u00fclkiyet hakk\u0131 olmas\u0131na ra\u011fmen hukuki olarak m\u00fcdahalede bulunabilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Hukuki el atma ger\u00e7ekle\u015fti\u011finde ta\u015f\u0131nmaz malik \u00fczerinde kalmakla birlikte m\u00fclkiyet hakk\u0131nda k\u0131s\u0131tlamaya gidilir. Malikin m\u00fclkiyet hakk\u0131na getirilen bu k\u0131s\u0131tlama s\u00fcresiz olur. Malike ait m\u00fclkiyet hakk\u0131n\u0131n s\u00fcresiz olarak k\u0131s\u0131tlanmas\u0131 ise \u00f6zel m\u00fclkiyeti s\u00fcre bak\u0131m\u0131ndan oldu\u011fu kadar i\u00e7erik y\u00f6n\u00fcnden de kullan\u0131lamaz hale getirmektedir.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rmas\u0131z El Atma Unsurlar\u0131<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">\u00d6zel m\u00fclkiyete tabi olan ta\u015f\u0131nmazlara idarenin mevzuat h\u00fck\u00fcmlerine ayk\u0131r\u0131 olarak ve kamula\u015ft\u0131rma karar\u0131 olmadan el atmas\u0131 kamula\u015ft\u0131rmas\u0131z el atma olarak adland\u0131r\u0131lmaktad\u0131r. \u0130darenin m\u00fclkiyet hakk\u0131na k\u0131s\u0131tlama getirdi\u011fi bu uygulama s\u0131ras\u0131nda baz\u0131 unsurlar\u0131n varl\u0131\u011f\u0131 aran\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130darenin \u00f6zel m\u00fclkiyete tabi bir ta\u015f\u0131nmaza el atmas\u0131 bu unsurlardan biridir. Ta\u015f\u0131nmaza yap\u0131lacak m\u00fcdahalenin kamula\u015ft\u0131rma yetkisi olan idare taraf\u0131ndan ger\u00e7ekle\u015ftirilmi\u015f olmas\u0131 icap eder.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Bunun yan\u0131 s\u0131ra el atman\u0131n amac\u0131 kamu yarar\u0131 olmal\u0131d\u0131r. Malikin m\u00fclkiyet hakk\u0131n\u0131n kal\u0131c\u0131 olarak s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f olmas\u0131 da kamula\u015ft\u0131rmas\u0131z el atmada olmas\u0131 gereken unsurlardan biridir.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rmas\u0131z Fiili ve Hukuki El Atma Farklar\u0131<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rmas\u0131z fiili ve hukuki el atma farklar\u0131 bak\u0131m\u0131ndan incelendi\u011finde idare usul ve esaslar y\u00f6n\u00fcnden ayk\u0131r\u0131 hareket etti\u011finde ve \u00f6zel m\u00fclkiyet hakk\u0131n\u0131 kal\u0131c\u0131 olarak k\u0131s\u0131tlad\u0131\u011f\u0131nda fiili el atmadan s\u00f6z edilebilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Hukuki el atman\u0131n olu\u015fabildi\u011fi durumlarda fiili el atman\u0131n ger\u00e7ekle\u015fmi\u015f olmas\u0131na gerek duyulmaz. Fiili kamula\u015ft\u0131rmas\u0131z el atma olu\u015ftu\u011funda idarenin haks\u0131z fiili ortaya \u00e7\u0131km\u0131\u015f demektir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Malik bu t\u00fcr bir durumla kar\u015f\u0131la\u015ft\u0131\u011f\u0131nda yasalar arac\u0131l\u0131\u011f\u0131 ile itiraz edebilir. Malik yarg\u0131ya ba\u015f vurdu\u011funda Asliye Hukuk Mahkemesi\u2019ne m\u00fcracaat etmelidir. A\u00e7\u0131lan davan\u0131n niteli\u011fi ise m\u00fcdahalenin meni, ecrimisil talebi ve tazminat istemi olabilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Hukuki el atman\u0131n olu\u015fmas\u0131 durumunda malikin m\u00fclkiyet hakk\u0131 kal\u0131c\u0131 olarak k\u0131s\u0131tlan\u0131r. S\u00fcre ve i\u00e7erik a\u00e7\u0131s\u0131ndan kullan\u0131lamaz hale gelen malikin m\u00fclkiyet hakk\u0131 Anayasa taraf\u0131ndan korunmaktad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130dare 5 y\u0131ll\u0131k s\u00fcre i\u00e7erisinde el atma yapt\u0131\u011f\u0131 ta\u015f\u0131nmaz \u00fczerinde gereken i\u015flemleri yapmad\u0131\u011f\u0131nda hukuki el atmaya ba\u011fl\u0131 olarak ta\u015f\u0131nmaz \u00fczerindeki yetkisi k\u0131s\u0131tlanm\u0131\u015f olan malik kamula\u015ft\u0131rmay\u0131 yapan idare aleyhinde dava a\u00e7abilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">A\u00e7\u0131lacak dava idari yarg\u0131ya y\u00f6nelik olurken dava a\u00e7\u0131lmadan \u00f6nce malikin uzla\u015fmaya ba\u015fvurma zorunlu\u011fu bulunmamaktad\u0131r. Bu noktada belirtmekte fayda var ki usule ve esasa dair hatal\u0131 veya ihmali bir i\u015flemde bulunmamak ad\u0131na yetkin bir <a href=\"https:\/\/esen.av.tr\/en\/portfolio\/gayrimenkul-hukuku\/\"><strong>gayrimenkul avukat\u0131<\/strong><\/a>ndan hukuk yard\u0131m\u0131na ba\u015fvurmak en sa\u011fl\u0131kl\u0131 yakla\u015f\u0131m olacakt\u0131r.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rmas\u0131z El Atmada Tazminat Talebi Ko\u015fullar\u0131<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rmas\u0131z el atmada tazminat talebi \u015fartlar\u0131 yerine getirildi\u011finde malikin idareden ta\u015f\u0131nmaz\u0131n bedelini talep etme hakk\u0131 olu\u015fur. Bu \u015fartlar bir arada bulundu\u011fu takdirde malik ilgili idareden tazminat talebi yapabilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Bu ko\u015fullardan biri malike ait ta\u015f\u0131nmaz\u0131n imar plan\u0131 \u00e7er\u00e7evesinde ye\u015fil saha, okul ya da park alan\u0131 olarak g\u00f6r\u00fcnmesidir. Bu uygulama nedeni ile ta\u015f\u0131nmaza y\u00f6nelik d\u00fc\u015f\u00fclen d\u00fczenlemenin ortakl\u0131k pay\u0131 da %45\u2019in \u00fczerinde olmal\u0131d\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Kesinle\u015fmi\u015f imar planlar\u0131 s\u00f6z konusu ise ve imar plan\u0131n\u0131n kesinle\u015fmi\u015f olmas\u0131na ra\u011fmen ilgili idarenin kamula\u015ft\u0131rma i\u015flemini ger\u00e7ekle\u015ftirmemi\u015f olmas\u0131 da gerekir. Bu \u015fartlar bir arada sa\u011fland\u0131\u011f\u0131nda malik ilgili idareden tazminat talep edebilmektedir.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rmas\u0131z El Atma Durumunda Ne Yap\u0131lmal\u0131d\u0131r?<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130darenin kamula\u015ft\u0131rmas\u0131z el atma yapmas\u0131 halinde ta\u015f\u0131nmaz\u0131n bedelinin idareden talep edilebilmesi baz\u0131 ko\u015fullara ba\u011fl\u0131d\u0131r. Fiili ya da hukuki el atmada ta\u015f\u0131nmaz\u0131n tapuya kay\u0131tl\u0131 olmas\u0131 durumunda bedeli idareden talep edilebilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Bunun yan\u0131 s\u0131ra dava a\u00e7\u0131laca\u011f\u0131 zaman tapu sahibi taraf\u0131ndan bu i\u015flemin yap\u0131lmas\u0131 icap eder. Kamula\u015ft\u0131rmas\u0131z el atma sebebi ile kamu kurumunun <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=2942&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">kamula\u015ft\u0131rma kanunu<\/a> d\u0131\u015f\u0131nda hareket etmesi s\u00f6z konusu olmaktad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Dava a\u00e7\u0131laca\u011f\u0131 zaman m\u00fclkiyete tecav\u00fcz\u00fcn \u00f6nlenmesi amac\u0131 g\u00fcd\u00fcl\u00fcr. Bunun yan\u0131 s\u0131ra haks\u0131z fiilin yol a\u00e7aca\u011f\u0131 zarar\u0131n tazmini de dava s\u0131ras\u0131nda talep edilir. Kamula\u015ft\u0131rmas\u0131z el atma davas\u0131n\u0131 davac\u0131 s\u0131fat\u0131 ile gayrimenkul\u00fcne haks\u0131z bi\u00e7imde el konulan tapu sahibi a\u00e7ar.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Tapu sahibi malikin vefat etmi\u015f olmas\u0131 durumunda ise davay\u0131 miras\u00e7\u0131lar a\u00e7abilmektedir. Fiili el atma s\u00f6z konusu ise g\u00f6revli ve yetkili mahkeme gayrimenkul\u00fcn bulundu\u011fu yer Asliye Hukuk Mahkemesi\u2019dir. \u0130dare Mahkemeleri ise hukuki el atmalarda g\u00f6revli ve yetkilidir.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rmas\u0131z Hukuki El Atma Davalar\u0131nda G\u00f6revli ve Yetkili Mahkeme<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rmas\u0131z el atma idarenin fiili ve hukuki olarak yapabilece\u011fi uygulamalar neticesinde ortaya \u00e7\u0131kabilir. Malikin ta\u015f\u0131nmaz \u00fczerindeki m\u00fclkiyet hakk\u0131 Anayasa ile g\u00fcvence alt\u0131na al\u0131n\u0131r. M\u00fclkiyet hakk\u0131n\u0131n kamula\u015ft\u0131rmas\u0131z el atma y\u00f6ntemlerinden biri kullan\u0131larak hukuka ayk\u0131r\u0131 bi\u00e7imde s\u00fcresiz olarak s\u0131n\u0131rland\u0131r\u0131lmas\u0131 durumunda yarg\u0131 yoluna ba\u015fvurulabilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Malik bu t\u00fcr bir durumla kar\u015f\u0131la\u015ft\u0131\u011f\u0131nda g\u00f6revli ve yetkili mahkeme arac\u0131l\u0131\u011f\u0131 ile dava a\u00e7abilir. Hukuki el atmadan kaynaklanan durumlar s\u00f6z konusu oldu\u011funda a\u00e7\u0131lan davalar da adli yarg\u0131y\u0131 ilgilendirmektedir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Bu kapsamda a\u00e7\u0131lacak davada Asliye Hukuk Mahkemesi g\u00f6revli olurken ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesi de yetkili bulunur. Malik i\u00e7in zamana\u015f\u0131m\u0131 s\u00fcresi \u00f6ng\u00f6r\u00fclmez. \u0130dare aleyhinde tazminat ya da el atman\u0131n \u00f6nlenmesi y\u00f6n\u00fcnde dava a\u00e7acak olan malik zamana\u015f\u0131m\u0131 s\u00fcresine tabi de\u011fildir.<\/p>\n<h2 style=\"text-align: center;\">Kamula\u015ft\u0131rmas\u0131z El Atma Yarg\u0131tay Kararlar\u0131<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Yarg\u0131tay 5. Hukuk Dairesi\u2019nin kamula\u015ft\u0131rmas\u0131z el atmaya ili\u015fkin 20.02.2019 tarihli karar\u0131 \u015fu \u015fekildedir:<\/p>\n<blockquote>\n<p style=\"font-weight: 400; text-align: justify;\">Taraflar aras\u0131ndaki kamula\u015ft\u0131rmas\u0131z el at\u0131lan ta\u015f\u0131nmaza el atman\u0131n \u00f6nlenmesi, kal m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 takdirde el atma nedeniyle tazminat davas\u0131ndan dolay\u0131 yap\u0131lan yarg\u0131lama sonunda: Davan\u0131n k\u0131smen kabul\u00fcne dair verilen yukar\u0131da g\u00fcn ve say\u0131lar\u0131 yaz\u0131l\u0131 h\u00fckm\u00fcn Yarg\u0131tay&#8217;ca incelenmesi, davac\u0131 taraf\u0131ndan verilen dilek\u00e7e ile istenilmi\u015f olmakla, dosyadaki belgeler okunup uyu\u015fmazl\u0131k anla\u015f\u0131ld\u0131ktan sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">&#8211; K A R A R &#8211;<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Dava, kamula\u015ft\u0131rmas\u0131z el at\u0131lan ta\u015f\u0131nmaza el atman\u0131n \u00f6nlenmesi, kal m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 takdirde el atma nedeniyle tazminat istemine ili\u015fkindir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Mahkemece elatman\u0131n \u00f6nlenmesi ve kal talepleri y\u00f6n\u00fcnden davan\u0131n reddine, kamula\u015ft\u0131rmas\u0131z el atma nedeniyle tazminat bedeli y\u00f6n\u00fcnden davan\u0131n kabul\u00fcne karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Dosyada bulunan kan\u0131t ve belgelere, karar\u0131n dayand\u0131\u011f\u0131 gerek\u00e7elere g\u00f6re, davan\u0131n k\u0131smen kabul\u00fcne karar verilmesinde bir isabetsizlik g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Davac\u0131n\u0131n temyiz itirazlar\u0131 yerinde olmad\u0131\u011f\u0131ndan usul ve yasaya uygun olan h\u00fckm\u00fcn ONANMASINA, pe\u015fin al\u0131nan temyiz ve temyize ba\u015fvurma har\u00e7lar\u0131n\u0131n &#8230;&#8230;ye irad kaydedilmesine, 20\/02\/2019 g\u00fcn\u00fcnde oybirli\u011fiyle karar verildi.<\/p>\n<\/blockquote>\n<h2 style=\"text-align: justify;\">Kamula\u015ft\u0131rmas\u0131z El Atma Dava Dilek\u00e7esi<\/h2>\n<p style=\"font-weight: 400; text-align: justify;\">Kamula\u015ft\u0131rmas\u0131z el atma nedeniyle tazminat istemli dava dilek\u00e7esi \u00f6rne\u011fi a\u015fa\u011f\u0131da yer almaktad\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: center;\">\u2026\u2026 \u0130DARE MAHKEMES\u0130 BA\u015eKANLI\u011eI\u2019NA;<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u00a0<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">DAVACI\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 :<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u00a0<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">T.C.
