Tek tarafl\u0131 bir hukuki i\u015flem olan <em>tahliye taahh\u00fctnamesi<\/em>, kirac\u0131n\u0131n kiraya konu ta\u015f\u0131nmaz\u0131 belirli bir tarihte bo\u015faltaca\u011f\u0131n\u0131 ifade etti\u011fi ve bunu yaz\u0131l\u0131 \u015fekilde \u00fcstlendi\u011fi irade beyan\u0131d\u0131r. <strong>Tahliye taahh\u00fctnamesi<\/strong>nin hukuk d\u00fczeninde ge\u00e7erlilik kazanabilmesi i\u00e7in belirli \u015fartlar\u0131 haiz olmas\u0131 gerekir. Bu \u015fartlar \u015funlard\u0131r:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Taahh\u00fct yaz\u0131l\u0131 \u015fekle tabidir.<\/li>\n<li>Kirac\u0131n\u0131n imzas\u0131n\u0131 i\u00e7ermelidir. Birden fazla kirac\u0131 mevcutsa kirac\u0131lar\u0131n tamam\u0131n\u0131n imzas\u0131 bulunmal\u0131d\u0131r.<\/li>\n<li>Tahliye edilecek ta\u015f\u0131nmaz (konut, i\u015f yeri vs.) a\u00e7\u0131k\u00e7a belirtilmelidir.<\/li>\n<li>Tahliye taahh\u00fcd\u00fc herhangi bir \u015farta ba\u011flanmamal\u0131d\u0131r.<\/li>\n<li>D\u00fczenleme tarihi belirtilmelidir. Tahliye taahh\u00fcd\u00fcn\u00fcn d\u00fczenlendi\u011fi tarih, kira s\u00f6zle\u015fmesinden sonraki bir tarih olmal\u0131d\u0131r. Aksi takdirde, kira s\u00f6zle\u015fmesinden \u00f6nce ya da ayn\u0131 tarihte d\u00fczenlenen taahh\u00fct ge\u00e7erli de\u011fildir.<\/li>\n<li>Tahliye tarihi belirtilmelidir.<\/li>\n<li>Tarih belirtilmeyen tahliye taahh\u00fctlerinde ev sahibi taraf\u0131ndan sonradan tarih belirtilmesi Yarg\u0131tay taraf\u0131ndan hukuka uygun kabul edilmektedir.<\/li>\n<li>Kiralanan ta\u015f\u0131nmaz\u0131n aile konutu olarak kullan\u0131lacak olmas\u0131 durumunda, kira s\u00f6zle\u015fmesinde ad\u0131 yaz\u0131l\u0131 e\u015fin yaln\u0131z ba\u015f\u0131na taahh\u00fcd\u00fc imzalamas\u0131 yeterli de\u011fildir. Di\u011fer e\u015fin de imzas\u0131 al\u0131nmal\u0131d\u0131r. Aksi takdirde, her iki e\u015fin imzas\u0131n\u0131 i\u00e7ermeyen tahliye taahh\u00fcd\u00fcne istinaden aile konutunun tahliyesi m\u00fcmk\u00fcn de\u011fildir.<\/li>\n<li>Taahh\u00fctnamede belirtilen tarihi takiben bir ay s\u00fcre ile tahliye istemiyle icra takibi ba\u015flat\u0131lmal\u0131d\u0131r. Bunun yan\u0131 s\u0131ra, do\u011fruda tahliye davas\u0131 yoluna da gidilebilir. S\u00f6z konusu s\u00fcreye dikkat edilmelidir. Aksi halde, tahliyeye dair talep hakk\u0131 d\u00fc\u015fer. Dava a\u00e7mak i\u00e7in \u00f6ng\u00f6r\u00fclen bir ayl\u0131k s\u00fcre zarf\u0131nda kirac\u0131ya bildirimde bulunmak suretiyle dava a\u00e7\u0131laca\u011f\u0131 ihtar edilirse, tahliye davas\u0131 a\u00e7ma s\u00fcresi o kira y\u0131l\u0131 s\u00fcresince uzam\u0131\u015f kabul edilir.<\/li>\n<li>Kirac\u0131, tebli\u011f edilen tahliye emrine itirazda bulunurken taahh\u00fctteki imzaya veya d\u00fczenleme tarihine itiraz etmedi\u011fi takdirde, itiraz\u0131n kald\u0131r\u0131lmas\u0131 amac\u0131yla icra mahkemesine ba\u015fvurmak suretiyle dava yoluna gitmek durumundad\u0131r. \u0130mzaya veya d\u00fczenleme tarihine itiraz etmi\u015f ve taahh\u00fct noterde d\u00fczenlenmemi\u015fse, itiraz\u0131n kald\u0131r\u0131lmas\u0131 amac\u0131yla icra mahkemesinde dava yoluna gidemez. Sulh hukuk mahkemesine ba\u015fvurarak tahliye davas\u0131 a\u00e7mal\u0131d\u0131r.<\/li>\n<\/ul>\n<h2 style=\"text-align: center;\">Tahliye Taahh\u00fctnamesi \u015eartlar\u0131<\/h2>\n<p style=\"text-align: justify;\">Kirac\u0131n\u0131n, belirli bir tarihte kiralanan\u0131 bo\u015faltaca\u011f\u0131n\u0131 yaz\u0131l\u0131 \u015fekilde \u00fcstlenmesine tahliye taahh\u00fcd\u00fc denir. <strong>Tahliye taahh\u00fctnamesi<\/strong>, h\u00fck\u00fcm alt\u0131na al\u0131nd\u0131\u011f\u0131 madde metninden de anla\u015f\u0131laca\u011f\u0131 \u00fczere belirli \u015fartlara ba\u011flanm\u0131\u015ft\u0131r. Bahse konu \u015fartlar \u015fu \u015fekilde ifade edilebilir:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Yaz\u0131l\u0131 \u015fekilde d\u00fczenlenmeli,<\/li>\n<li>Tahliye tarihi belirtilmeli,<\/li>\n<li>Kirac\u0131 ya da yetkili temsilcisi arac\u0131l\u0131\u011f\u0131yla verilmeli,<\/li>\n<li>Kiralanan\u0131n tesliminden sonra verilmelidir.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Tahliye taahh\u00fcd\u00fcne istinaden <a href=\"https:\/\/esen.av.tr\/en\/kira-tespit-davasi\/\">kira<\/a> akdini sona erdirmek isteyen kiralayan; icra takibi yoluyla tahliye takip etmek ve sulh hukuk mahkemesinde dava a\u00e7mak olmak \u00fczere iki farkl\u0131 yola ba\u015fvurabilir. \u0130cra takibi yoluyla tahliye s\u00fcreci \u0130\u0130K m.272 ve devam\u0131 maddelerinde h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. 2004 say\u0131l\u0131 <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.3.2004.pdf\" target=\"_blank\" rel=\"noopener\">\u0130cra ve \u0130flas Kanunu<\/a>\u2019nun 272\u2019inci maddesi gere\u011fi, mukavelename ile kiralanan bir ta\u015f\u0131nmaz\u0131n m\u00fcddeti sona erdikten sonra bir ay s\u00fcre ile mukavelenin icra dairesine ibraz edilmesiyle tahliye edilmesi talep edilebilir.<\/p>\n<p style=\"text-align: justify;\">Bahse konu talebin ard\u0131ndan, icra memuru marifetiyle tahliye emri tebli\u011f edilerek ilgili ta\u015f\u0131nmaz\u0131n on be\u015f g\u00fcn s\u00fcre ile tahliye edilmesi ve teslim olunmas\u0131 emredilir. Tahliye emrinde;<\/p>\n<ul style=\"text-align: justify;\">\n<li>Kiraya verenin ad\u0131, soyad\u0131 ve yerle\u015fim yeri (varsa temsilcisinin ad\u0131 soyad\u0131),<\/li>\n<li>Kirac\u0131n\u0131n ad\u0131, soyad\u0131 ve yerle\u015fim yeri (varsa temsilcisinin ad\u0131 soyad\u0131),<\/li>\n<li>S\u00f6zle\u015fme (mukavele) tarihi,<\/li>\n<li>Kiran\u0131n yenilendi\u011fine veya uzat\u0131ld\u0131\u011f\u0131na ili\u015fkin bir itiraz\u0131n s\u00f6z konusu olmas\u0131 halinde yedi g\u00fcn s\u00fcre ile daireye ba\u015fvurmak suretiyle beyan edilmesi, itiraz edilmedi\u011fi veya re\u2019 sen tahliye olunmad\u0131\u011f\u0131 takdirde zorla \u00e7\u0131kar\u0131laca\u011f\u0131 belirtilir.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">S\u00f6z konusu tahliye emrine kar\u015f\u0131 s\u00fcresi i\u00e7inde itiraz edilmemesi veya itiraz\u0131n kald\u0131r\u0131lmas\u0131 halinde, s\u00fcrenin sona ermesiyle, ilgili ta\u015f\u0131nmaz zorla tahliye edilerek kiraya verene teslim edilir. Fakat, bu prosed\u00fcr\u00fcn yerine getirilebilmesi i\u00e7in tahliye emrinde belirtilen s\u00fcrenin tamamlanmas\u0131 \u015fartt\u0131r. Kirac\u0131 itiraz etmek isterse, tahliye emrinin tebli\u011f oldu\u011fu an itibariyle yedi g\u00fcn s\u00fcre zarf\u0131nda s\u00f6zle veya dilek\u00e7eyle icra dairesine ba\u015fvurmal\u0131d\u0131r. Usul\u00fcne uygun itiraz ba\u015fvurusu, tahliye takibinin durmas\u0131 sonucunu do\u011furur.<\/p>\n<p style=\"text-align: justify;\">Kirac\u0131n\u0131n itiraz\u0131 halinde, kiraya veren itiraz\u0131n kald\u0131r\u0131lmas\u0131 talebiyle icra mahkemesine ba\u015fvurabilir. Tahliye istemi noter taraf\u0131ndan kendili\u011finden tanzim veya tarih ve imzas\u0131 tasdik edilmi\u015f ya da ikrar olunmu\u015f bir s\u00f6zle\u015fmeye dayanan ve kirac\u0131 kiran\u0131n uzat\u0131ld\u0131\u011f\u0131na yahut yenilendi\u011fine ili\u015fkin emsal mahiyet ve kuvvette bir belge ibraz etmedi\u011fi takdirde itiraz kald\u0131r\u0131l\u0131r.
