Y\u0131k\u0131m karar\u0131na itiraz<\/strong>, karara konu yap\u0131n\u0131n ilgilileri i\u00e7in son derece \u00f6nemli sonu\u00e7lar do\u011furur. Hakk\u0131nda y\u0131k\u0131m karar\u0131 bulunan yap\u0131n\u0131n malikleri, y\u0131k\u0131m karar\u0131 veren idari mercie m\u00fcracaat ederek y\u0131k\u0131m karar\u0131n\u0131n iptalini talep edebilirler. Bu talep, y\u0131k\u0131m karar\u0131na itiraz<\/strong> olarak isimlendirilir. Ki\u015filere ait m\u00fclkiyet hakk\u0131n\u0131 s\u0131n\u0131rland\u0131ran bir idari i\u015flem olan y\u0131k\u0131m karar\u0131n\u0131n hukuka uygun bir bi\u00e7imde d\u00fczenlenmesi gerekir.<\/p>\n

Yap\u0131lara ili\u015fkin idarenin y\u0131k\u0131m karar\u0131<\/strong> s\u00f6z konusu oldu\u011funda; itiraz ve dava s\u00fcrecinin hangisinin i\u015fletilmesi gerekti\u011fi, m\u00fcspet sonuca ula\u015f\u0131labilmesi i\u00e7in nas\u0131l bir haz\u0131rl\u0131k ve \u00e7al\u0131\u015fma yap\u0131lmas\u0131 gerekti\u011fi gibi somut olay\u0131n \u00f6zelliklerine g\u00f6re de\u011ferlendirilmesi gereken konular, yetkin ve deneyimli bir gayrimenkul avukat\u0131<\/a> nezaretinde y\u00fcr\u00fct\u00fclmelidir.<\/p>\n

Y\u0131k\u0131m Karar\u0131 Nedir?<\/h2>\n

Y\u0131k\u0131m karar\u0131<\/strong>; belediye enc\u00fcmeni taraf\u0131ndan imara, usule, mevzuata ayk\u0131r\u0131l\u0131k te\u015fkil eden yap\u0131lar i\u00e7in nihai se\u00e7enek yapt\u0131r\u0131md\u0131r. M\u00fclkiyet hakk\u0131na getirilen m\u00fchim bir s\u0131n\u0131rlama olan y\u0131k\u0131m karar\u0131n\u0131n, hukuka uygun verilmi\u015f bir karar olmas\u0131 gerekir. S\u00f6z konusu karar\u0131n verilme usul\u00fcne dair d\u00fczenleme 3194 Say\u0131l\u0131 \u0130mar Kanunu<\/a> ile d\u00fczenleme alt\u0131na al\u0131nm\u0131\u015ft\u0131r. \u0130\u015fbu yasa d\u00fczenlemesi ile ruhsat almadan yap\u0131labilecek istisna haller hari\u00e7 olmak \u00fczere, bunun haricindeki yap\u0131lar i\u00e7in \u00e7e\u015fitli zorunluluklar getirilmi\u015ftir.<\/p>\n

Ruhsat al\u0131nmas\u0131 gerekirken ruhsat almaks\u0131z\u0131n in\u015faat yap\u0131lmas\u0131 yahut mevzuat ve yasaya tezat bir bi\u00e7imde bir yap\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131n\u0131n yetkili idari makamlar taraf\u0131ndan tespiti durumunda do\u011frudan y\u0131k\u0131m karar\u0131 al\u0131nmaz. \u0130lgili yap\u0131 hakk\u0131nda al\u0131nacak y\u0131k\u0131m karar\u0131<\/strong> son se\u00e7enektir. Fakat y\u0131k\u0131m karar\u0131n\u0131n uygulamada zaman zaman hukuka ayk\u0131r\u0131 olarak verildi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n

Yap\u0131 Tatil Zapt\u0131<\/h2>\n

Ruhsat al\u0131nmadan ya da ruhsata, mevzuata, yasaya ayk\u0131r\u0131 \u015fekilde yap\u0131lan yap\u0131lar\u0131n belediye taraf\u0131ndan tespit edilmesi durumunda yahut bu durumdan haberdar olunmas\u0131 halinde ilgili yap\u0131da durum tespiti yaparak ayk\u0131r\u0131 durumu tespit etmesi halinde ilk olarak yap\u0131n\u0131n m\u00fch\u00fcrlenmesine ve in\u015faat\u0131n durdurulmas\u0131na karar verir. Bu i\u015flem ile beraber ilgili yap\u0131ya tatil zapt\u0131 as\u0131l\u0131r.<\/p>\n

Tatil zapt\u0131<\/strong>n\u0131n yap\u0131ya as\u0131ld\u0131\u011f\u0131 tarihte, yap\u0131da devam eden in\u015faat\u0131n durduruldu\u011funa dair karar\u0131n ilgiliye tebli\u011f edildi\u011fi kabul eder. S\u00f6z konusu zapt\u0131 g\u00f6ren ilgilinin, tebli\u011f tarihinden sonra idare taraf\u0131ndan tespit edilecek s\u00fcre i\u00e7inde in\u015faat\u0131n durdurulmas\u0131na neden olan ayk\u0131r\u0131l\u0131klar\u0131 gidererek karar\u0131 veren yetkili makamdan in\u015faat durdurma karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131n\u0131 talep etme hakk\u0131n\u0131 haizdir.<\/p>\n

Tespit edilen ayk\u0131r\u0131l\u0131klar\u0131n giderilerek idareye m\u00fcracaat edilmesi durumunda idare, bu konuya dair gereken kontrolleri yaparak aksakl\u0131klar\u0131n giderilip giderilmedi\u011fini kontrol eder. Aksakl\u0131klar\u0131n giderildi\u011fini tespit etti\u011fi takdirde yap\u0131daki m\u00fch\u00fcr kald\u0131r\u0131l\u0131r. M\u00fch\u00fcr g\u00f6ren ilgilinin, aksakl\u0131klar\u0131 gidermemesi halinde herhangi bir \u015fey yapmaz ise yap\u0131n\u0131n ruhsat\u0131 iptal edilir ve yetkili makamlar taraf\u0131ndan y\u0131k\u0131m karar\u0131 al\u0131narak yap\u0131n\u0131n y\u0131kt\u0131r\u0131lmas\u0131 i\u015flemine ba\u015flan\u0131r.<\/p>\n

\u0130fade edildi\u011fi \u00fczere y\u0131k\u0131m karar\u0131<\/strong> nihai yapt\u0131r\u0131md\u0131r. Mevzuata ayk\u0131r\u0131l\u0131k te\u015fkil eden yap\u0131lar i\u00e7in evvela tatil zapt\u0131 d\u00fczenlenmelidir. Tatil zapt\u0131 i\u015fleminin ard\u0131ndan yap\u0131 m\u00fch\u00fcrlenerek ilgiliye, yap\u0131da tespit edilen ayk\u0131r\u0131l\u0131klar\u0131n giderilmesi i\u00e7in en fazla bir ay s\u00fcre verilir.<\/p>\n

\u0130dare taraf\u0131ndan ilgiliye yap\u0131lan bildirim, yap\u0131da bulunan ve giderilmesi gereken ayk\u0131r\u0131l\u0131klar\u0131n tamam\u0131n\u0131 ayr\u0131nt\u0131l\u0131 bir bi\u00e7imde ihtiva eder. \u0130dare, yap\u0131 tatil zapt\u0131 d\u00fczenlemeksizin y\u0131k\u0131m karar\u0131<\/strong> ald\u0131\u011f\u0131 takdirde yahut yap\u0131 tatil zapt\u0131<\/strong> ile mevcut ayk\u0131r\u0131l\u0131klar\u0131n tamam\u0131n\u0131 net bir bi\u00e7imde belirtmez ise, y\u0131k\u0131m karar\u0131n\u0131n hukuka ayk\u0131r\u0131l\u0131\u011f\u0131 s\u00f6z konusu olacakt\u0131r.<\/p>\n

Y\u0131k\u0131m Karar\u0131na Kar\u015f\u0131 \u0130tiraz Yolu<\/h2>\n

\u0130dari mercilerce al\u0131nan y\u0131k\u0131m karar\u0131<\/strong> bir idari i\u015flemdir. Bu itibarla, idarece al\u0131nan y\u0131k\u0131m kararlar\u0131 ve yap\u0131 tatil tutana\u011f\u0131na kar\u015f\u0131 itiraz, \u0130dari Yarg\u0131lama Usul\u00fc Kanunu ile tanzim edilen usul\u00fc g\u00f6re ger\u00e7ekle\u015ftirilir. Y\u0131k\u0131m karar\u0131n\u0131n ilgilileri, idari makamlardan bu karar\u0131n kald\u0131r\u0131lmas\u0131n\u0131 talep edebilir. Burada alt\u0131 \u00e7izilmesi gereken \u00f6nemli husus \u015fu ki; y\u0131k\u0131m karar\u0131na kar\u015f\u0131 iptal davas\u0131 a\u00e7\u0131lmas\u0131 i\u00e7in ilk olarak itiraz yoluna ba\u015fvuru \u015fart\u0131 bulunmamaktad\u0131r. Bu nedenle, karara kar\u015f\u0131 do\u011frudan iptal davas\u0131 a\u00e7\u0131labilir.<\/p>\n

Y\u0131k\u0131k karar\u0131na itiraz i\u00e7in, karar\u0131n ilgiliye tebli\u011fini takip eden altm\u0131\u015f g\u00fcnl\u00fck s\u00fcre i\u00e7inde idareye ba\u015fvuruda bulunulmal\u0131d\u0131r. Karar\u0131n tebli\u011fi ise, yap\u0131n\u0131n g\u00f6r\u00fcn\u00fcr bir b\u00f6l\u00fcm\u00fcne yap\u0131 tatil zapt\u0131n\u0131n as\u0131lmas\u0131 ile ger\u00e7ekle\u015fir. Hukuka ayk\u0131r\u0131l\u0131k iddias\u0131 ile karar\u0131n kald\u0131r\u0131lmas\u0131 i\u00e7in idareye yap\u0131lan ba\u015fvuru neticesinde idare bir karar verir. \u0130dare, olumsuz bir karar verebilir veya altm\u0131\u015f g\u00fcn i\u00e7inde herhangi bir karar vermez ise ilgili, idarece verilen olumsuz karar ya da altm\u0131\u015f g\u00fcnl\u00fck s\u00fcrenin ard\u0131ndan altm\u0131\u015f g\u00fcn i\u00e7inde iptal davas\u0131 a\u00e7abilir.<\/p>\n

Y\u0131k\u0131m Karar\u0131na Kar\u015f\u0131 Dava Yolu<\/h2>\n

Y\u0131k\u0131m kararlar\u0131n\u0131n iptale konu edilebilmesi i\u00e7in karar\u0131n hukuka ayk\u0131r\u0131l\u0131k te\u015fkil etmesi gerekir. Y\u0131k\u0131m karar\u0131n\u0131n hukuka ayk\u0131r\u0131l\u0131k te\u015fkil etmesine neden olabilen haller \u015fu \u015fekilde s\u0131ralanabilir:<\/p>\n

  • Ayk\u0131r\u0131l\u0131k sebeplerinin tutanakta sarih bir bi\u00e7imde ifade edilmemesi,<\/li>\n
  • Yap\u0131n\u0131n tamam\u0131n\u0131n ayk\u0131r\u0131l\u0131k te\u015fkil etmemesine kar\u015f\u0131n tamam\u0131n\u0131n m\u00fch\u00fcrlenmesi,<\/li>\n
  • Tutanakta ifade eden ayk\u0131r\u0131l\u0131klar\u0131n giderilmesi ad\u0131na herhangi bir s\u00fcre tan\u0131nmamas\u0131.<\/li>\n<\/ul>\n

    Karar\u0131n hukuka ayk\u0131r\u0131 olmas\u0131na neden olan haller yaln\u0131zca s\u0131ralanan haller ile s\u0131n\u0131rl\u0131 de\u011fildir. Y\u0131k\u0131m karar\u0131 s\u00fcrecinde ger\u00e7ekle\u015ftirilen i\u015flemlerin bir\u00e7o\u011funda hukuka ayk\u0131r\u0131l\u0131k olabilir. \u0130\u015flemlerin hangisinde ne gibi bir hukuka ayk\u0131r\u0131l\u0131k oldu\u011fu hususunda uzman deste\u011fi almak en do\u011fru yakla\u015f\u0131m olacakt\u0131r.<\/p>\n

    Y\u0131k\u0131m karar\u0131n\u0131n iptali<\/strong> talepli a\u00e7\u0131lacak davada \u0130dare Mahkemeleri g\u00f6revli mahkemelerdir. \u0130\u015fbu dava yaln\u0131zca karar\u0131n muhatab\u0131 olan ki\u015filerce a\u00e7\u0131labilir. Y\u0131k\u0131m karar\u0131n\u0131 veren idari makam ise davan\u0131n daval\u0131 taraf\u0131d\u0131r. Mahkeme, idarenin verdi\u011fi karar\u0131n hukuka ayk\u0131r\u0131l\u0131k te\u015fkil edip etmedi\u011fine ve ilgili mevzuata tezat bir durumun olup olmad\u0131\u011f\u0131na dair de\u011ferlendirme yapar. De\u011ferlendirme neticesinde karar\u0131n hukuka ayk\u0131r\u0131 oldu\u011fu sonucuna var\u0131l\u0131r ise karar\u0131n iptali y\u00f6n\u00fcnde h\u00fck\u00fcm verilir. Karar\u0131n hukuka uygun oldu\u011funa kanaat edildi\u011fi takdirde ise iptal davas\u0131n\u0131n reddine karar verilir. \u0130ptal davas\u0131n\u0131n ret karar\u0131na kar\u015f\u0131 kanun yollar\u0131 a\u00e7\u0131kt\u0131r.<\/p>\n

    \u0130ptal Davas\u0131 A\u00e7\u0131lmas\u0131 Halinde Y\u0131k\u0131m Karar\u0131 Durur Mu?<\/h2>\n

    Y\u0131k\u0131m karar\u0131<\/strong>na ya da yap\u0131 tatil tutana\u011f\u0131na itiraz yahut bu i\u015flemlerin iptali talepli iptal davas\u0131, y\u0131k\u0131m i\u015fleminin durdurulmas\u0131 i\u00e7in k\u00e2fi de\u011fildir. Yap\u0131n\u0131n y\u0131k\u0131lmas\u0131na m\u00e2ni olabilmek i\u00e7in, iptal davas\u0131n\u0131n y\u00fcr\u00fctmeyi durdurma talebini ihtiva eder \u015fekilde a\u00e7\u0131lmas\u0131 gerekir. S\u00f6z konusu taleple a\u00e7\u0131lan davada mahkeme, talebin hakl\u0131 olup olmad\u0131\u011f\u0131n\u0131 de\u011ferlendirmeye alarak davan\u0131n neticelenmesine kadar y\u0131k\u0131m i\u015fleminin durdurulmas\u0131na karar verebilir. Bu nedenle, dijital ortamlarda haz\u0131rlanm\u0131\u015f taslak niteli\u011fi ta\u015f\u0131yan y\u0131k\u0131m karar\u0131na itiraz dilek\u00e7esi \u00f6rne\u011fi<\/strong> kullanmak, somut olay\u0131n ger\u00e7eklerini yans\u0131tmakta eksik kalaca\u011f\u0131 i\u00e7in dava s\u00fcrecinin olumsuz etkilenmesine neden olacakt\u0131r.
