Bunlar, aynen taksim suretiyle ortakl\u0131\u011f\u0131n giderilmesi ve sat\u0131\u015f suretiyle ortakl\u0131\u011f\u0131n giderilmesidir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Aynen Taksim Suretiyle<\/strong>\u00a0Ortakl\u0131\u011f\u0131n Giderilmesi<\/h2>\n\n\n\n<p>Aynen taksim suretiyle ortakl\u0131\u011f\u0131n giderilmesinde ta\u015f\u0131n\u0131r mallarda ortaklara ayn\u0131 t\u00fcrden mal\u0131n verilmesi gerekir. Ta\u015f\u0131nmazlarda ise ta\u015f\u0131nmaz\u0131n b\u00f6l\u00fcn\u00fcp b\u00f6l\u00fcnemeyece\u011fi ve b\u00f6l\u00fcnd\u00fc\u011f\u00fcndeki de\u011fer kayb\u0131 ihtimaline bak\u0131larak m\u00fcmk\u00fcn olup olmad\u0131\u011f\u0131na karar verilir. M\u00fcmk\u00fcn oldu\u011fu takdirde ortaklara b\u00f6l\u00fcnerek verilen par\u00e7alar\u0131n de\u011ferlerinin denk olmas\u0131 gerekir. Ta\u015f\u0131nmaz\u0131n \u00f6nemli \u00f6l\u00e7\u00fcde de\u011fer kaybetmesi \u00fczerine aynen b\u00f6l\u00fcnerek payla\u015ft\u0131r\u0131lmas\u0131na karar verilemez. \u00a0Aynen taksim ile ortakl\u0131\u011f\u0131n giderilmesi y\u00f6ntemi taraflardan birinin istemi ile yap\u0131labilir. (MK 699\/2 \u2018\u2019 Payla\u015fma bi\u00e7iminde anla\u015fma sa\u011flanamazsa, payda\u015flardan birinin istemi \u00fczerine hakim, aynen b\u00f6l\u00fcnerek payla\u015ft\u0131r\u0131lmas\u0131na, b\u00f6l\u00fcnen par\u00e7alar\u0131n de\u011ferlerinin birbirine denk d\u00fc\u015fmemesi halinde eksik de\u011ferdeki par\u00e7aya para eklenerek denkle\u015ftirme sa\u011flamas\u0131na karar verir.\u2019\u2019). Mahkeme \u00f6nce ortakl\u0131\u011f\u0131n giderilmesi istenen menkul veya gayrimenkul\u00fcn aynen taksim edilebilir olup olmad\u0131\u011f\u0131n\u0131 inceler. Bu alanda uzman bilirki\u015filer g\u00f6revlendirilir. \u0130ncelenen hususlar arazinin niteli\u011fi, imar durumu, y\u00fcz\u00f6l\u00e7\u00fcm\u00fc, pay ve payda\u015f say\u0131s\u0131 gibi etmenlerdir. Ta\u015f\u0131nmaz\u0131n aynen taksimi m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 durumlarda sat\u0131\u015f suretiyle ortakl\u0131\u011f\u0131n giderilmesine karar verilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sat\u0131\u015f suretiyle Ortakl\u0131\u011f\u0131n giderilmesi<\/h2>\n\n\n\n<p>Sat\u0131\u015f suretiyle ortakl\u0131\u011f\u0131n giderilmesinde ise t\u00fcm payda\u015flar bir araya gelerek sat\u0131\u015f\u0131n ortaklar aras\u0131nda yap\u0131lmas\u0131 hususunda oybirli\u011fiyle anla\u015ft\u0131klar\u0131 takdirde sat\u0131\u015f yaln\u0131zca ortaklar aras\u0131nda yap\u0131l\u0131r. A\u00e7\u0131k artt\u0131rma yolu ile yap\u0131l\u0131r. Ta\u015f\u0131n\u0131r veya ta\u015f\u0131nmaz\u0131n icra yoluyla sat\u0131\u015f\u0131 yap\u0131larak payda\u015flar aras\u0131nda bedeli b\u00f6l\u00fc\u015ft\u00fcr\u00fcl\u00fcr. Burada dikkat edilmesi gereken husus ta\u015f\u0131nmaz \u00fczerinde muhdesat (a\u011fa\u00e7, ba\u011f, bina, tesis vb) bulunmas\u0131 durumudur. Muhdesat\u0131n kime ait oldu\u011fu ve de\u011ferinin ne oldu\u011fu tespit edilir. Ta\u015f\u0131nmaz\u0131n de\u011ferinin payda\u015flara b\u00f6l\u00fcnmesinden sonra muhdesat sahibine a\u011fa\u00e7, ev vb. lerin bedeli \u00f6denir. Belirtmek gerekir ki muhdesat\u0131n aitli\u011fi ile ilgili durumda payda\u015flar aras\u0131nda bir tart\u0131\u015fma var ise bunun belirlenmesi i\u00e7in \u2018\u2019muhdesat\u0131n aidiyetinin tespiti davas\u0131\u2019\u2019 ayr\u0131ca a\u00e7\u0131lmas\u0131 gerekir.
