Ayn\u0131 zamanda arsa pay\u0131 kavram\u0131n\u0131n Anayasan\u0131n 35&#8217;inci maddesinde yer alan \u201cm\u00fclkiyet hakk\u0131\u201d kapsam\u0131nda da ele al\u0131nd\u0131\u011f\u0131n\u0131 belirtiliyor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kanunda Arsa Pay\u0131<\/h2>\n\n\n\n<p>Arsa pay\u0131 kavram\u0131n\u0131n Kentsel D\u00f6n\u00fc\u015f\u00fcm Kanunu olarak bilinen 6306 say\u0131l\u0131 \u201cAfet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi Hakk\u0131nda Kanun\u201d \u00e7er\u00e7evesinde b\u00fcy\u00fck \u00f6nem kazand\u0131\u011f\u0131n\u0131 ifade edebiliriz. Kanuna g\u00f6re eski yap\u0131n\u0131n y\u0131k\u0131l\u0131p yeniden yap\u0131lmas\u0131 s\u0131ras\u0131nda ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sahibi ki\u015filerin, sahip olduklar\u0131 arsa pay\u0131 hisseleri oran\u0131nda \u00fc\u00e7te iki \u00e7o\u011funlukla karar verebilme haklar\u0131 oldu\u011funu da rahatl\u0131kla dile getirebiliriz. Benzer \u015fekilde, 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanununa g\u00f6re de maliklerin sahip olduklar\u0131 hak ve y\u00fck\u00fcml\u00fcl\u00fckleri kullanmalar\u0131n\u0131n da arsa paylar\u0131yla orant\u0131l\u0131 oldu\u011funu hat\u0131rlatma fayda var.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Arsa Pay\u0131 Nas\u0131l Payla\u015ft\u0131r\u0131l\u0131r ?<\/h2>\n\n\n\n<p>Arsa pay\u0131 belirlenirken yetkili kimselerin, arsa\u00a0 paylar\u0131n\u0131 objektif, hakkaniyete ve yasalara uygun payla\u015ft\u0131rmas\u0131 gerekmektedir. Bununla beraber uygulamada proje m\u00fcelliflerinden ve\/veya yap\u0131mc\u0131 m\u00fcteahhitlerden baz\u0131lar\u0131n\u0131n ticari endi\u015felerle veya konunun uzman\u0131 olmad\u0131klar\u0131 i\u00e7in arsa pay\u0131n\u0131 objektiflikten uzak bir bi\u00e7imde ve kanunda belirtilen kriterleri dikkate almadan tespit etti\u011fi herkes\u00e7e bilinmektedir. Yani ayn\u0131 b\u00fcy\u00fckl\u00fckte de olsa deniz g\u00f6ren bir daire ile istinat duvar\u0131na bakan ayn\u0131 bina ve kattaki dairenin de\u011ferinin ayn\u0131 olmayaca\u011f\u0131 i\u00e7in arsa pay\u0131 da ayn\u0131 olmamal\u0131d\u0131r. Fakat \u00f6zellikle eski yap\u0131larda arsa paylar\u0131n\u0131n adil olmayan \u015fekilde da\u011f\u0131t\u0131lm\u0131\u015f \u00f6rneklerine rastlan\u0131yor.
