Hacizli gayrimenkullerin sat\u0131\u015f\u0131 bu \u015fekilde yap\u0131lmaktad\u0131r. Bir mal\u0131n \u00fczerindeki haciz i\u015flemi kesin hale geldi\u011finde bor\u00e7lu olan tarafa ait olan mallar ile alacakl\u0131 almas\u0131 gerekti\u011fi tutar\u0131 tahsil eder.<\/p>\n\n\n\n<p>Menkullerin sat\u0131l\u0131\u015f\u0131 yed-i emin olarak nitelendirilen m\u00fcessese ya da ki\u015fiye teslim edilen mallar\u0131n a\u00e7\u0131k artt\u0131rma yoluyla sat\u0131lmas\u0131 \u015feklinde bor\u00e7 miktar\u0131 tahsil edilir. Gayrimenkul haczinde ise gayrimenkul\u00fcn tapu kayd\u0131 \u00fczerinden haciz kayd\u0131 d\u00fc\u015f\u00fcl\u00fcr ve bu \u015fekilde i\u015flem yap\u0131l\u0131r. Yasa h\u00fckm\u00fc gere\u011fince borcu giderecek olan tutar kadar mala tatbik edilmesi gerekmektedir. Haciz edilen gayrimenkuller, alacakl\u0131n\u0131n talebi \u00fczerine sat\u0131\u015fa \u00e7\u0131kar\u0131l\u0131r. Sat\u0131\u015f i\u015flemi yine menkulde oldu\u011fu gibi a\u00e7\u0131k artt\u0131rma \u015feklinde yap\u0131lmaktad\u0131r. Sat\u0131\u015f\u0131n ger\u00e7ekle\u015ftirilmesi i\u00e7in alacakl\u0131n\u0131n almas\u0131 gereken tutar\u0131 kar\u015f\u0131layacak ve masraflar\u0131 da kar\u015f\u0131layacak orana ula\u015f\u0131lmas\u0131 gerekir. Bunun i\u00e7in a\u00e7\u0131k artt\u0131rma i\u015flemi online ortamda teklif edilen en y\u00fcksek mebla\u011f ile a\u00e7\u0131l\u0131r. \u00a0E\u011fer sat\u0131lan gayrimenkulden al\u0131nan para oran\u0131 bedelin yar\u0131s\u0131n\u0131 ve di\u011fer t\u00fcm masraflar\u0131 \u00f6demeyecek miktarda ise ikinci bir sat\u0131\u015f d\u00fczenlenir ve yine ayn\u0131 \u015fartlar aran\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0130hale ve Sat\u0131\u015f S\u00fcreci<\/h2>\n\n\n\n<p>\u0130haleye giren ki\u015filer, tahmin edilen gayrimenkul de\u011ferinin %20\u2019si kadarl\u0131k bir teminat \u00f6demesi yapmas\u0131 gerekmektedir. T\u00fcm bu yap\u0131lacak olan i\u015flemler online \u015fekilde y\u00fcr\u00fct\u00fclmektedir. Haciz edilen ve sat\u0131\u015fa \u00e7\u0131kar\u0131lan gayrimenkullerde kirac\u0131n\u0131n bulunmas\u0131 i\u015flemler i\u00e7in herhangi bir engel olu\u015fturmaz. Bu durum kar\u015f\u0131s\u0131nda kirac\u0131lar\u0131n gayrimenkul sahibine \u00f6demeleri gereken kira bedelini kime vermeleri gerekti\u011fi konusunda bir kar\u0131\u015f\u0131kl\u0131k ya\u015fanmamas\u0131 ad\u0131na haciz i\u015flemlerini y\u00fcr\u00fcten icra m\u00fcd\u00fcrl\u00fc\u011f\u00fcnden durumu bildiren resmi bir evrak kirac\u0131n\u0131n kendisine g\u00f6nderilerek durum bildirisi yap\u0131l\u0131r. Kira bedelinin bu s\u00fcre \u00e7er\u00e7evesinde icra dairesine \u00f6denmesi gerekmektedir. Bunun d\u0131\u015f\u0131nda damga resmi ve tellaliye resminin de eklenmesi gerekmektedir.
