Kira bedelinin tespiti davas\u0131, <strong><a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.6098.pdf\" target=\"_blank\" rel=\"noopener\">6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu<\/a><\/strong>\u2019nun 343.maddesi ve devam\u0131 h\u00fck\u00fcmlerinde d\u00fczenleme alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<h2>Kira Bedeli Nas\u0131l Belirlenir?<\/h2>\n<p><strong>Kira bedeli<\/strong>nin nas\u0131l belirlenece\u011fine ili\u015fkin izlenecek hukuki prosed\u00fcr, TBK md.344\u2019te d\u00fczenlenmi\u015ftir. Yenilenen kira d\u00f6nemlerinde, belirli s\u0131n\u0131rlamalara tabi kalmak kayd\u0131yla kiraya veren taraf\u0131ndan kirac\u0131 aleyhine de\u011fi\u015fiklik yap\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Kira bedelinin belirlenmesinde ilk olarak tamamlanan kira d\u00f6neminde t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalama referans al\u0131narak de\u011fi\u015fim oran\u0131 tespit edilir. Kira s\u00f6zle\u015fmesi taraflar\u0131n\u0131n, yeni kira d\u00f6nemi i\u00e7in mutab\u0131k kald\u0131klar\u0131 kira bedelinin de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memesi gerekir. Kira bedelinin, de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memesi \u015fart\u0131 sadece 1 y\u0131ll\u0131k kira s\u00f6zle\u015fmeleri i\u00e7in de\u011fil, 1 y\u0131ldan fazla s\u00fcreli kira s\u00f6zle\u015fmeleri i\u00e7in de ge\u00e7erlidir.<\/p>\n<p><strong>Kira s\u00f6zle\u015fmesi<\/strong> taraflar\u0131, yukar\u0131da ifade edilen s\u0131n\u0131rlamaya tabi kalmak suretiyle kira bedeli \u00fczerinde anla\u015fma sa\u011flayamad\u0131klar\u0131 takdirde, \u00f6ng\u00f6r\u00fclen \u015fartlar\u0131n da ger\u00e7ekle\u015fmesiyle kira bedelinin h\u00e2kim taraf\u0131ndan tespit edilmesi sa\u011flan\u0131r. H\u00e2kim, yine ilgili s\u0131n\u0131rlamay\u0131 g\u00f6z \u00f6n\u00fcnde bulundurmak suretiyle kiralanan\u0131n durumunu ve \u00f6zelliklerini de\u011ferlendirerek hakkaniyet \u00e7er\u00e7evesinde karar verir.<\/p>\n<h2>Kira Tespit Davas\u0131 \u015eartlar\u0131<\/h2>\n<p><strong>Kira tespit davas\u0131<\/strong> a\u00e7\u0131labilmesi i\u00e7in belirli \u015fartlar\u0131n kar\u015f\u0131lanmas\u0131 gerekir. \u00d6ncelikle, taraflar aras\u0131nda ge\u00e7erli bir kira s\u00f6zle\u015fmesi bulunmal\u0131d\u0131r. Kira s\u00f6zle\u015fmesinin yaz\u0131l\u0131 olmas\u0131 \u015fart\u0131 yoktur. Kirac\u0131 ve kiraya veren, s\u00f6zl\u00fc iradeleri \u00fczerine de kira s\u00f6zle\u015fmesi kurabilir. \u0130\u015fbu davan\u0131n a\u00e7\u0131labilmesi i\u00e7in kar\u015f\u0131lanmas\u0131 gereken bir di\u011fer \u015fart ise hukuki yarard\u0131r. Davan\u0131n a\u00e7\u0131lmas\u0131 ile hukuki yarar elde edilemeyecekse, kira bedelinin tespiti davas\u0131 a\u00e7\u0131lamaz.<\/p>\n<p><strong>Kira tespit davas\u0131nda g\u00f6revli mahkeme<\/strong> Sulh Hukuk Mahkemesidir. Yetkili mahkeme ise, davaya konu ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesidir. Davac\u0131, g\u00f6rev ve yetki kurallar\u0131nda hataya d\u00fc\u015ft\u00fc\u011f\u00fc takdirde davan\u0131n reddedilmesi gibi menfi sonu\u00e7lar do\u011fabilir. Dolay\u0131s\u0131yla dava a\u00e7\u0131lmadan \u00f6nce, deneyimli bir <strong><a href=\"https:\/\/esen.av.tr\/ar\/iletisim\/\">gayrimenkul hukuku avukat\u0131<\/a><\/strong>ndan hukuki yard\u0131m al\u0131nmas\u0131 yararl\u0131 olacakt\u0131r.<\/p>\n<p>Kira bedelinin tespiti davas\u0131n\u0131n ne zaman a\u00e7\u0131labilece\u011fi, uygulamada merak edilen konulardand\u0131r. Bu konu, TBK md.345 d\u00fczenlemesi ile yan\u0131tlanm\u0131\u015f olup buna g\u00f6re i\u015fbu dava her zaman a\u00e7\u0131labilir.<\/p>\n<h2>Kira Tespit Davas\u0131nda 5 Y\u0131l Kural\u0131<\/h2>\n<p><strong>Kira tespit davas\u0131<\/strong>, kira s\u00f6zle\u015fmesinin 5. Y\u0131l\u0131n\u0131 tamamlamadan \u00f6nce a\u00e7\u0131lmas\u0131 halinde mahkeme; kira bedelinin tespit edilmesinde senelik T\u00dcFE oran\u0131n\u0131 belirler ve hakkaniyet \u00e7er\u00e7evesinde kiraya h\u00fckmeder. Kirac\u0131 ve kiraya veren aras\u0131nda yap\u0131lan kira s\u00f6zle\u015fmesinde, T\u00dcFE oran\u0131ndan daha az art\u0131\u015f oran\u0131 \u00fczerinde anla\u015fma sa\u011flanm\u0131\u015fsa mahkeme davay\u0131 reddeder. Fakat taraflar herhangi bir oran \u00fczerinde anla\u015fma sa\u011flamam\u0131\u015f ve kirac\u0131, T\u00dcFE oran\u0131n\u0131n alt\u0131nda bir kira art\u0131\u015f oran\u0131 ile \u00f6deme yap\u0131yorsa ya da kira bedelini art\u0131rmaks\u0131z\u0131n \u00f6demede bulunuyorsa, T\u00dcFE oran\u0131na kadar art\u0131r\u0131m yap\u0131lacakt\u0131r.<\/p>\n<p><strong>Kira tespit davas\u0131<\/strong>, 5. Y\u0131l\u0131n\u0131 doldurmu\u015f bir kira s\u00f6zle\u015fmesine dayan\u0131larak a\u00e7\u0131l\u0131yorsa mahkeme; T\u00dcFE oran\u0131na ba\u011fl\u0131 kalmadan T\u00dcFE oran\u0131 \u00fczerinde bir art\u0131\u015fa karar verebilir. Bu noktada mevcut piyasa ve ekonomi durumu i\u00e7in bilirki\u015fi raporuna, kirac\u0131n\u0131n kiralananda kald\u0131\u011f\u0131 s\u00fcreye ve sair pek \u00e7ok hususa dikkat ederek belirleme yap\u0131l\u0131r.<\/p>\n<h2>Kira Tespit Davas\u0131nda \u00d6nemli Hususlar<\/h2>\n<p><strong>Kira tespit davas\u0131<\/strong>, gerekli \u015fartlar\u0131n varl\u0131\u011f\u0131 halinde arzu edilen herhangi bir zamanda a\u00e7\u0131labilir. Fakat, i\u015fbu davan\u0131n ne zaman a\u00e7\u0131ld\u0131\u011f\u0131, mahkemece belirlenen yeni kira bedelinin hangi kira d\u00f6neminde uygulanaca\u011f\u0131 a\u00e7\u0131s\u0131ndan farkl\u0131l\u0131k g\u00f6sterir. Kira bedelinin tespiti davas\u0131, yeni kira d\u00f6nemi ba\u015flamadan otuz g\u00fcn \u00f6nce a\u00e7\u0131ld\u0131\u011f\u0131 takdirde mahkemece belirlenen yeni kira bedeli, yeni kira d\u00f6neminin ba\u015flamas\u0131yla birlikte ge\u00e7erlilik kazan\u0131r.<\/p>\n<p><strong>Kira tespit davas\u0131<\/strong>, yeni kira d\u00f6nemi ba\u015flamadan otuz g\u00fcn \u00f6nce kira bedelinin art\u0131r\u0131laca\u011f\u0131na dair bildirimde bulunmak suretiyle yeni kira d\u00f6neminde a\u00e7\u0131ld\u0131\u011f\u0131 takdirde, mahkemece belirlenecek yeni kira bedeli, yeni kira d\u00f6neminin ba\u015flamas\u0131yla birlikte ge\u00e7erli olur. Kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin otuz g\u00fcn \u00f6nce bildirimde bulunma \u015fart\u0131 sa\u011flanmad\u0131\u011f\u0131 takdirde mahkemece verilen karar, bir sonraki kira d\u00f6neminin ba\u015flamas\u0131yla ge\u00e7erli olur.<\/p>\n<p>Kiraya veren ve kirac\u0131, kira s\u00f6zle\u015fmesinde kira bedelinin art\u0131r\u0131laca\u011f\u0131na dair bir h\u00fck\u00fcm belirlemi\u015flerse, otuz g\u00fcn \u015fart\u0131na ba\u011fl\u0131 kal\u0131nmaks\u0131z\u0131n yeni kira d\u00f6nemi sona ermeden a\u00e7\u0131lan kira bedelinin tespiti davas\u0131 neticesinde belirlenen yeni kira tutar\u0131, yeni kira d\u00f6neminin ba\u015flad\u0131\u011f\u0131 g\u00fcn itibariyle ge\u00e7erlilik kazan\u0131r.<\/p>\n<p><strong>Kira bedelinin tespiti davas\u0131<\/strong>nda verilen karar kesinle\u015fmedi\u011fi takdirde icra takibine konu edilebilmesi m\u00fcmk\u00fcn de\u011fildir. Fakat mahkeme karar\u0131n\u0131n kesinle\u015fmesiyle birlikte icra takibi s\u00f6z konusu olabilir. \u00d6te yandan, belirlenen yeni kira bedeline g\u00f6re \u00f6deme yap\u0131lmamas\u0131 durumunda kirac\u0131n\u0131n ta\u015f\u0131nmazdan tahliye edilmesi i\u00e7in gereken hukuki s\u00fcre\u00e7 i\u015fletilebilir.<\/p>\n<h2>Kira Tespit Davas\u0131 Kim Taraf\u0131ndan A\u00e7\u0131l\u0131r?<\/h2>\n<p><strong>Kira tespit davas\u0131<\/strong>n\u0131n a\u00e7\u0131lmas\u0131nda hukuki yarar\u0131 bulunan ki\u015fi, kira bedelinin tespiti davas\u0131n\u0131 a\u00e7ma hakk\u0131n\u0131 haizdir. Kira s\u00f6zle\u015fmesinin taraflar\u0131, s\u00f6zle\u015fme nedeniyle i\u015fbu davadan hukuki yarar\u0131 olan ki\u015filerdir. Dolay\u0131s\u0131yla kira s\u00f6zle\u015fmesi kiminle yap\u0131ld\u0131ysa, davan\u0131n o ki\u015fi aleyhine a\u00e7\u0131lmas\u0131 gerekir. Kira bedelinin tespiti davas\u0131 yaln\u0131zca kiraya veren taraf\u0131ndan de\u011fil, kirac\u0131 taraf\u0131ndan da a\u00e7\u0131labilir. Kirac\u0131, kiraya verenin yasada ifade edilen yahut s\u00f6zle\u015fmede mutab\u0131k kal\u0131nan s\u0131n\u0131rlar\u0131 ihlal etmek suretiyle kira bedeli tespit ederse, kira bedelinin tespiti davas\u0131n\u0131 a\u00e7abilir.<\/p>\n<p>S\u00f6z konusu dava, kira s\u00f6zle\u015fmesine taraf ki\u015filerce a\u00e7\u0131labilece\u011fi gibi, davaya konu edilen ta\u015f\u0131nmaz\u0131n maliki ve olmas\u0131 halinde payda\u015flar\u0131 taraf\u0131ndan da a\u00e7\u0131labilir. E\u011fer dava konusu i\u015ftirak halinde m\u00fclkiyete tabi ise, s\u00f6z gelimi miras\u00e7\u0131lar\u0131n beraber dava a\u00e7mas\u0131 ya da bir miras\u00e7\u0131 taraf\u0131ndan a\u00e7\u0131lan kira tespit davas\u0131na di\u011fer miras\u00e7\u0131lar\u0131n da kat\u0131lmas\u0131 gerekir. Davaya konu ta\u015f\u0131nmaz\u0131n m\u00fc\u015fterek m\u00fclkiyete tabi olmas\u0131 halinde ise her bir payda\u015f, pay sahipli\u011fi oran\u0131nda kira tespiti davas\u0131 a\u00e7ma hakk\u0131n\u0131 haizdir.<\/p>\n<p>Son olarak, kira s\u00f6zle\u015fmesine konu ta\u015f\u0131nmaz\u0131n kira s\u00f6zle\u015fmesi devam ederken el de\u011fi\u015ftirmesi halinde ta\u015f\u0131nmaz\u0131n yeni maliki, eski malik ile ayn\u0131 haklara sahip olaca\u011f\u0131 i\u00e7in yeni malikin kira bedelinin tespiti davas\u0131n\u0131 a\u00e7abilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<h2>Kira Tespit Davas\u0131 Dilek\u00e7esi Nas\u0131l Haz\u0131rlan\u0131r?<\/h2>\n<p><strong>Kira bedelinin tespiti<\/strong> talepli dava dilek\u00e7esi haz\u0131rlan\u0131rken, somut olay\u0131n \u00f6nemli ayr\u0131nt\u0131lar\u0131na de\u011finilmesi, dava s\u00fcrecinin m\u00fcspet seyri a\u00e7\u0131s\u0131ndan \u00f6nemidir. Dava dilek\u00e7esinin, do\u011fru hukuki gerek\u00e7eler \u00fczerine temellendirilmemesi halinde davac\u0131, telafisi g\u00fc\u00e7 hak kay\u0131plar\u0131 ya\u015fayabilir. Dijital ortamda payla\u015f\u0131lan dava dilek\u00e7esi \u00f6rneklerine dayan\u0131larak haz\u0131rlanan dava dilek\u00e7elerinin, somut olay\u0131n ko\u015fullar\u0131n\u0131 ve \u00f6zelliklerini ihtiva etmeyece\u011fi sebebiyle ki\u015fi ad\u0131na yarardan \u00e7ok zarar getirece\u011fi a\u00e7\u0131kt\u0131r. Hukuki ve usuli hatalardan uzak bir dava dilek\u00e7esi i\u00e7in hukuki yard\u0131m al\u0131nmas\u0131 daha isabetli ve yararl\u0131 olacakt\u0131r.<\/p>\n<h3>Kira Tespit Davas\u0131 S\u00fcresi<\/h3>\n<p><strong>Kira tespit davas\u0131<\/strong> s\u00fcresine ili\u015fkin yasal d\u00fczenleme mevcut de\u011fildir. Bu itibarla davan\u0131n ne kadar s\u00fcrece\u011fini net bir tarih vererek ifade etmek m\u00fcmk\u00fcn de\u011fildir. Davan\u0131n s\u00fcresine; ilgili mahkemenin i\u015f y\u00fck\u00fc ve yo\u011funlu\u011fu, duru\u015fma aral\u0131klar\u0131, delillerin mahkemeye ibraz edilmesi ve de\u011ferlendirilmesi, s\u00fcrecin uzman bir avukat nezaretinde y\u00fcr\u00fct\u00fclmesi gibi bir\u00e7ok husus etki eder.
